This week's parsha ends with the punishments for violating the עריות: {:he .lines} ><b>ז</b> והתקדשתם והייתם קדשים; כי אני ה׳ אלקיכם׃... <b>י</b> ואיש אשר ינאף את אשת איש אשר ינאף את אשת רעהו מות יומת הנאף והנאפת׃... <b>יג</b> ואיש אשר ישכב את זכר משכבי אשה תועבה עשו שניהם; מות יומתו דמיהם בם׃... <b>טו</b> ואיש אשר יתן שכבתו בבהמה מות יומת; ואת הבהמה תהרגו׃ ...<b>כה</b> והבדלתם בין הבהמה הטהרה לטמאה ובין העוף הטמא לטהר; ולא תשקצו את נפשתיכם בבהמה ובעוף ובכל אשר תרמש האדמה אשר הבדלתי לכם לטמא׃ <b>כו</b> והייתם לי קדשים כי קדוש אני ה׳; ואבדל אתכם מן העמים להיות לי׃</p> --ויקרא פרק כ Rashi comments on this idea of הבדלה: {:he} ><em>ואבדל אתכם מן העמים להיות לי</em>:...רבי אלעזר בן עזריה אומר: מנין שלא יאמר אדם נפשי קצה בבשר חזיר, אי אפשי ללבוש כלאים; אבל יאמר אפשי, ומה אעשה ואבי שבשמים גזר עלי: תלמוד לומר ”ואבדיל אתכם מן העמים להיות לי“, שתהא הבדלתכם מהם לשמי, פורש מן העבירה ומקבל עליו עול מלכות שמים. --רש״י, ויקרא כ:כו That is an important idea, but it doesn't seem to fit the context. The Torah mentions הבדלתם בין הבהמה הטהרה לטמאה, so the בשר חזיר makes sense, but who mentioned לבוש כלאים? And what about the main topic of the paragraph, the עריות? We have noted many times that Rashi doesn't quote Midrashim. He cites them, but adapts them to his own pedagogical purposes. It's worth looking at the original Sifra: {:he} >רבי אלעזר בן עזריה אומר: מנין שלא יאמר אדם אי איפשי ללבוש שעטנז, אי אפשי לאכול בשר חזיר, *אי איפשי לבוא על הערוה*, אבל איפשי; מה אעשה ואבי שבשמים גזר עלי כך: ת״ל ”ואבדיל אתכם מן העמים להיות לי“; נמצא פורש מן העבירה ומקבל עליו מלכות שמים. --ספרא קדושים ט:יב The examples of בשר חזיר and לבוש כלאים come from an earlier Sifra, from last week's parsha, about a distinction that we are all familiar with: {:he} >(ויקרא יח:ד) <em>את משפטי תעשו</em>: אלו דברים הכתובים בתורה שאילו לא נכתבו בדין היה לכתבן... > <em>ואת חקתי [תשמרו ללכת בהם; אני ה׳ אלקיכם]</em>: אלו שיצר הרע משיב עליהם ועכו"ם משיבין עליהם כגון אכילת חזיר ולבישת כלאים...תלמוד לומר ”אני ה'“--חקקתים! אין אתה רשאי להשיב עליהם. --ספרא אחרי מות יג:ט So Rashi is in effect saying that רבי אלעזר בן עזריה's comment applies to the חוקים. Rambam says this explicitly. Rambam, in his introduction to פרקי אבות, talks about character development. It is possible for us to work on ourselves and our own emotional responses to sin. The question is, should we? He deals with the question of which is better, a מְעֻלֶּה, an "elevated" person, a person of such sterling character that they do not even desire to sin; or a ֹמוֹשֵל בְּנַפְשו, a person desires sin but overcomes that desire. He cites משלי כא:י,‎ נֶפֶשׁ רָשָׁע, אִוְּתָה רָע and other sources, that the מְעֻלֶּה is moraly superior. Then he cites our Sifra that seems to contradict this. {:he} >וּלְפִי הַמּוּבָן מִפְּשׁוּטֵי שְׁנֵי הַמַּאֲמָרִים בִּתְחִלַּת הַמַּחֲשָׁבָה הֵם סוֹתְרִים זֶה אֶת זֶה--וְאֵין הָעִנְיָן כֵּן; אֲבָל שְׁנֵיהֶם אֱמֶת וְאֵין מַחֲלֹקֶת בֵּינֵיהֶם כְּלָל. וְהוּא: שֶׁהָרָעוֹת אֲשֶׁר הֵן אֵצֶל הַפִּילוֹסוֹפִים רָעוֹת, אֲשֶׁר אָמְרוּ: שֶׁמִי שֶׁלֹּא יִתְאַוֶּה אֲלֵיהֶן יוֹתֵר חָשׁוּב מִן הַמִּתְאַוֶּה אֲלֵיהֶן וְיִכְבּשׁ אֶת יִצְרוֹ מֵהֶן--הֵם הָעִנְיָנִים הַמְפֻרְסָמִים אֵצֶל כָּל בְּנֵי אָדָם שֶׁהֵם: ”רָעוֹת“: כִּשְׁפִיכוּת דָּמִים, וּגְנֵבָה, וּגְזֵלָה, וְאוֹנָאָה, וּלְהַזִּיק לְמִי שֶׁלֹּא הֵרַע לוֹ, וְלִגְמֹל רַע לְמֵיטִיב לוֹ, וְלִבְזוֹת אָב וָאֵם וְכַיּוֹצֵא בָאֵלּוּ. וְהֵן הַמִּצְווֹת שֶׁאָמְרוּ עֲלֵיהֶן הַחֲכָמִים, זִכְרוֹנָם לִבְרָכָה: ”שֶׁאִלּוּ לֹא נִכְתְּבוּ רְאוּיוֹת הֵן לִכָּתֵב“...וְאֵין סָפֵק שֶׁהַנֶּפֶשׁ אֲשֶׁר תִּכְסֹף לְדָבָר מֵהֶם וְתִשְׁתּוֹקֵק אֵלָיו, שֶׁהִיא חֲסֵרָה. > אֲבָל הַדְּבָרִים שֶׁאָמְרוּ עֲלֵיהֶם הַחֲכָמִים, שֶׁהַכּוֹבֵשׁ אֶת יִצְרוֹ מֵהֶם הוּא יוֹתֵר חָשׁוּב וּגְמוּלוּ יוֹתֵר גָּדוֹל, הֵם: ”הַתּוֹרוֹת הַשִּׁמְעִיּוֹת“; וְזֶה אֱמֶת, שֶׁאִלְמָלֵא הַתּוֹרָה לֹא הָיוּ רָעוֹת כְּלָל...בָּשָׂר בְּחָלָב, וּלְבִישַׁת שַׁעַטְנֵז, *וַעֲרָיוֹת*. וְאֵלּוּ הַמִּצְווֹת וְכַיּוֹצֵא בָהֶן, הֵן אֲשֶׁר קְרָאָן הַשֵּׁם יִתְבָּרֵךְ: *חֻקּוֹת*...וְעוֹבְדֵי כּוֹכָבִים מְשִׁיבִין עֲלֵיהֶם, וְהַשָּׂטָן מְקַטְרֵג בָּהֶם... > הִנֵּה הִתְבָּאֵר לְךָ מִכֹּל מַה שֶּׁאָמַרְנוּ אֵיזוֹ מִן הָעֲבֵרוֹת יִהְיֶה מִי שֶׁלֹא יִשְׁתּוֹקֵק אֲלֵיהֶן יוֹתֵר חָשׁוּב מִן הַמִּשְׁתּוֹקֵק אֲלֵיהֶן וְכוֹבֵשׁ יִצְרוֹ מֵהֶן, וְאֵיזוֹ מֵהֶן יִהְיֶה הָעִנְיָן בְּהֵפֶךְ. *וְזֶה חִדּוּשׁ נִפְלָא בְּהַעֲמִיד שְׁנֵי הַמַּאֲמָרִים*; וּלְשׁוֹנָם מוֹרָה עַל אֲמִתַּת מַה שֶּׁבֵּאַרְנוּ. </p> <footer class=source>רמב״ם, שמונה פרקים (הקדמה למםכת אבות), פרק שישי</footer></blockquote> We talk about classifying מצוות as חוקים or משפטים, as "commanded" or "rational". Secular legal theory has the same distinction, between <i lang=la>malum prohibitum</i> or <i lang=he>malum in se</i>. Rambam's חידוש is that it is clear there is no practical difference in terms of observance; both are prohibited. Rambam's חִדּוּשׁ נִפְלָא is that there is a נפקא מינה, a practical difference between them. For משפטים, we *should* feel revulsion for the act. It is inherently wrong, and even if ה׳ had not forbidden it, it should be anathema to us. If not, we need to work on our attitude. But for חוקים, there is no moral superiority in despising it; it is simply גזרת הכתוב. Note that we may still try to understand the reasons for חוקים; it's just that those reasons are not "natural". For instance, מצה on פסח is understandable, but not immoral. ---- So what did Rashi do to the Sifra's אי איפשי לבוא על הערוה? Rambam explicitly includes עריות in his list of חוקים. Rashi evidently felt that עריות were משפטים, and you *should* feel revulsion and say אי איפשי לבוא על הערוה. There actually is a disagreement in the Sifra; the Sifra on אחרי מות that we quoted lists מפשטים: {:he} ><em>את משפטי תעשו</em>: אלה הדברים הכתובים בתורה שאלו לא נכתבו בדין היה לכתבן כגון הגזלות ו*העריות*...ושפיכת דמים שאלו לא נכתבו בדין היה לכתבן. --ספרא אחרי מות יג:ט So there is a מחלקת between Elazar ben Azaryah and the /stam/ Sifra, and between Rashi and Rambam, on whether עריות are a משפט or not; whether we *ought* to be bothered by that behavior or whether we should simply accept it as G-d's command. And I think this disagreement persists. 60 years ago, an article in Tradition stated: >It is diffcult to understand why Rabbi Elazar ben Azaryah included illicit sexual relations in this category [/chukkim/]; they are, in fact, included among the "rational" ordinances in Yoma and Sifra. --Alexander Carlebach, [_Autonomy, Heteronomy and Theonomy_](https://traditiononline.org/autonomy-heteronomy-and-theonomy/), Tradition 6:1, Fall 1963, p. 14 Then, it was "obvious" that עריות are a משפט. After <i>Obergefell</i>, that's not so obvious. >[It] is no longer intelligible to many Americans...that a sexual act can be *wrong* even if no one gets hurt... > In the Orthodox world...one reasonable reaction is what I call “chokification,” or the declaration that laws...should be regarded as...beyond human comprehension... > A trend toward chokification of the halakhic prohibitions against homosexuality has been evident in Modern Orthodoxy for some time...This suggests that rationales seen as self-evident in the past are no longer intelligible to them. Yes. I think that the classification of whether a given מצוה is a חוק or a משפט changes, not just with the times but with the individual and their sense of inherent morality. The reason is that at its core, every משפט is a חוק. We do it <em>because</em> it is commanded. And every חוק is a משפט. We believe there are reasons for מצות, and the world we live in was created to be the world in which the תורה is the fundamental law. We just don't always see those reasons. Rav Soloveitchik, in a 1972 shiur, addressed a slightly different question: if משפטים are rational, why do they need to be divinely commanded? >[T]here are not sharply delineated territories or realms between those of non-rational precepts and those of rational laws. A clearly defined distinction between חוקים and משפטים is almost non-existent. It is a sheer illusion. Of course, the heartland, the central area, of משפטים, is illumined by a rationale, is explorable by the human reason, is accessible to the logos and *one's conscience is sensitive to משפטים* [emphasis mine--DHW]. This is only true as far as the central area is concerned, the heartland of משפטים. However, the peripheral territories are as strange and alien to the reason as the most mysterious חוקים... > That is the basic reason why secular ethics has failed. Because the element of חוק is not understandable and not comprehensible to secular man. When everything is reduced to משפט, there is no morality. --Rabbi Joseph B. That's tautological! The distinction between חוקים and משפטים no longer has any practial implication. But it is not a tautology. I'm not going to tell you what to feel about עריות. But there are things that we *intellectually* know are משפטים, that are inherently unethical, that Rav Soloveitchik calls "the heartland of משפטים", but still we don't *feel* any problem with them. That's when the Rambam says מִי שֶׁלֹּא יִתְאַוֶּה אֲלֵיהֶן יוֹתֵר חָשׁוּב מִן הַמִּתְאַוֶּה אֲלֵיהֶן וְיִכְבּשׁ אֶת יִצְרוֹ מֵהֶן, and that lack of feeling is the warning sign that we need to work on our מידות to internalize the values we proclaim. >It is unfortunate that yet again we have turned the tables and confused our values. Chazal say we should be disgusted by stealing, but not by pork. Most of us are disgusted by pork but not by stealing. This is something we picked up in our cultural environment, and will bequeath to the next generation unless we change the habitual responses to בין אדם לחבירו in our culture. And we must do so if we are to bring about a change in /middos/ in our children.
