This is a slightly different approach to <//פרשת כי תצא תשע״ט> This week's parasha is part of the long series of mitzvot that Moshe reviews. There's a one-liner that I want to focus on today: <blockquote lang=he><p>כי תבנה בית חדש ועשית מעקה לגגך; ולא תשים דמים בביתך כי יפל הנפל ממנו׃</p> <footer class=source>דברים כב:ח</footer></blockquote> Taken literally, this is a strangely specific law, and the halacha takes it as an archetype, a בנין אב, for what we might call municipal codes: <blockquote lang=he><p>רבי נתן אומר: מניין שלא יגדל אדם כלב רע בתוך ביתו ואל יעמיד סולם רעוע בתוך ביתו: ת״ל ”לא תשים דמים בביתך“.</p> <footer class=source>בבא קמא טו,ב</footer></blockquote> {:he} ><b>ז</b> אחד הגג ואחד כל דבר שיש בו סכנה וראוי שיכשול בה אדם וימות כגון שהיתה לו באר (או בור) בחצירו בין שיש בו מים בין שאין בו מים חייב לעשות חוליא גבוה י' טפחים או לעשות לה כיסוי כדי שלא יפול בה אדם וימות. > <b>ז</b> וכן כל מכשול שיש בו סכנת נפשות מצות עשה להסירו ולהשמר ממנו ולהזהר בדבר יפה שנאמר השמר לך ושמור נפשך ואם לא הסיר והניח המכשולות המביאים לידי סכנה ביטל מצות עשה ועובר בלא תשים דמים. --שולחן ערוך, חושן משפט תכז {:he} >אסור לגדל כלב רע אא"כ הוא אסור בשלשלאות של ברזל וקשור בהם ובעיר הסמוכה לספר מותר לגדלו וקושרו ביום ומתירו בלילה. --שולחן ערוך, חושן משפט תט:ג <blockquote lang=en><dl> <dt>due care</dt><dd>Due care, also referred to as ordinary care and reasonable care, is the standard of care where a reasonable person would exercise in the same situation or under similar circumstances. This standard of care is used in a tort action to determine whether a person was negligent.</dd> </dl> <footer class=source><a href="https://www.law.cornell.edu/wex/due_care">Cornell Legal Information Institute, <cite>due care</cite></a></footer></blockquote> לא תשים דמים בביתך כי יפל הנפל ממנו means that if someone *does* fall after you've put up an appropriate railing, you are not liable. ---- There's an interesting side note about the כלב רע: Rashi disagrees with the שולחן ערוך (whose opinion comes from the Rambam). {:he} ><em>משמתינן ליה</em>: למזיק מיהא להרוג אותו כלב ולסלק היזיקיה. --רש״י, כתובות מא,ב {:he} >ויש להביא סמך ראיה לדעת הרמב"ם [ושולחן ערוך] ממשנה (משנה נדרים ט:ג): קוֹנָם לְבַיִת זֶה שֶׁאֵינִי נִכְנָס, שֶׁהַכֶּלֶב רַע בְּתוֹכוֹ, אוֹ שֶׁהַנָּחָשׁ בְּתוֹכוֹ; אָמְרוּ לוֹ: מֵת הַכֶּלֶב, אוֹ שֶׁנֶּהֱרַג הַנָּחָשׁ, מותר. > ודברי חכמים נאמרים בדיוק נמרץ, ודייקו להזכיר בכלב מיתה דהיינו מיתה עצמית ובנחש הריגה, והיינו מפורש כהרמב"ם, דלדעת רש"י הול"ל גם בכלב נהרג ודו"ק. --תורה תמימה, דברים כב:ח ---- But I want to focus on a grammatical issue: כי יפל הנפל: when the faller falls. <blockquote lang=he><p><em>הנופל</em>: נקרא על שם סופו. וכן (דברים יז:ו) [עַל פִּי שְׁנַיִם עֵדִים אוֹ שְׁלֹשָׁה עֵדִים] יוּמַת הַמֵּת...(בראשית כה:כב) וַיִּתְרֹצֲצוּ הַבָּנִים [בְּקִרְבָּהּ], ומלות רבות לאין מספר נקראו על שם סופם. ולא נדע אם כן דרך הלשון או הוא דברי נבואה...</p> <footer class=source>אבן עזרא,דברים כב:ח</footer></blockquote> As a דרך הלשון, this is called prolepsis: <blockquote lang=en><dl> <dt>prolepsis</dt><dd>Anticipation, such as the representation or assumption of a future act or development as if presently existing or accomplished.</dd> </dl> <footer class=source><a href="https://www.merriam-webster.com/dictionary/prolepsis">Merriam-Webster, <cite>prolepsis</cite></a></footer></blockquote> The classic source of this grammatical use is from the ancient myth of the Ghostbusters: <blockquote lang=en><p>(1983) D. Aykroyd & H. Ramis, <cite>Ghostbusters</cite> (film script, third draft), p. 123. Venkman...: Okay. That’s it! I’m gonna turn this guy into toast.</p> <p>The lines in quot. 1983 do not in fact appear in the U.S. film <cite>Ghostbusters</cite> as released in 1985, since a considerable amount of the dialogue is ad-libbed. The actual words spoken by Venkman (played by Bill Murray) as he prepares to fire a laser-type weapon, are, ‘This chick is toast’; this is probably the origin of the proleptic construction which has gained particular currency</p> <footer class=source>Oxford English Dictionary, <cite>Toast</cite> (as cited by <a href="https://althouse.blogspot.com/2019/07/i-had-to-look-up-susan-collins-is-toast.html">Ann Althouse</a>)</footer></blockquote> ---- But Ibn Ezra offers another explanation: דברי נבואה. The Torah is telling us that this person *will fall*. Rashi takes that approach: <blockquote lang=he><p><em>כי יפל הנפל</em>: רָאוּי זֶה לִפֹּל, וְאַעַ״פִּ כֵן לֹא תִתְגַּלְגֵּל מִיתָתוֹ עַל יָדְךָ, שֶׁמְּגַלְגְּלִין זְכוּת עַל יְדֵי זַכַּאי וְחוֹבָה עַל יְדֵי חַיָּב.</p> <footer class=source>רש״י, דברים כב:ח</footer></blockquote> And the gemara puts it even more strongly: <blockquote lang=he><p>תנא דבי רבי ישמעאל: ”כי יפול הנופל ממנו“: ראוי זה ליפול מששת ימי בראשית שהרי לא נפל והכתוב קראו נופל אלא שמגלגלין זכות על ידי זכאי וחובה על ידי חייב.</p> <footer class=source>שבת לב,א</footer></blockquote> In other words, ולא תשים דמים בביתך כי יפל הנפל ממנו means that "[if you build according to code], there will be no liability כי--despite the fact that--someone falls", with the implied inverse: if you don't build to code, then you are liable. That was the פשט we brought above. Rashi adds that there is no defense to say that, clearly, G-d wanted this person to fall. Who am I to argue? This is a profound theological point in all the מצוות בין אדם לחבירו. You can never say, G-d wants it this way. I don't need to do anything. G-d created the world imperfect, and your job is to show Him how He got it wrong, כביכול. <blockquote lang=he><p>ושאלו להבעש״ט ז״ל הא דילתא בחולין קט,א: כל מה דאסר שרי כנגדו…באיזה אופן מותר כפירה? והשיב: בצדקה; לא תאמר לעני שיהיה לו בטחון ובודאי יעזור לו ה׳; רק תהיה כופר באותו שעה, ותעשה לו כל מה שבידך…</p> <footer class=source>פרדס יוסף, תרומה כה</footer></blockquote> ---- I want to ask, why is this מצווה here? The context is all the laws of family life, marriage and parenting, and the immediately prior מצווה is שילוח הקן: {:he} ><b>ו</b> כי יקרא קן צפור לפניך בדרך בכל עץ או על הארץ אפרחים או ביצים והאם רבצת על האפרחים או על הביצים לא תקח האם על הבנים׃ <b>ז</b> שלח תשלח את האם ואת הבנים תקח לך למען ייטב לך והארכת ימים׃ --דברים פרק כב Rashi says that just having the opportunity to build your railing means you have a בית חדש. That's a reward for all the previous מצוות that you did. {:he} ><em>כי תבנה בית חדש</em>: אם קימת מצות שלוח הקן, סופך לבנות בית חדש, ותקים מצות מעקה, שמצוה גוררת מצוה, ותגיע לכרם ושדה ולבגדים נאים, לכך נסמכו פרשיות הללו. --רש״י, דברים כב:ח But that's not very specific. Why this particular מצווה? The Torah Temimah says that there is a danger in doing שילוח הקן. The pasuk says הארכת ימים. You may take that as a promise, and not worry about your safety any more. Or worse, you may think "I'm taken care of; why should I worry about anyone else?" {:he} >ועפ״י זה יובן למה לא כתיב ”פן תפול“, בנוכח, כמו ”כי תבנה“ ו”עשית“, וכן למה נסמך דין זה למצות שלוח הקן. > ואפשר לומר בטעם הדבר, שלא יאמר זה שקיים מצות שלוח הקן שהוא כשבונה בית אין צריך לשמירה מנפילה ונזק, מפני כי במצות שלוח הקן (שקיים) כתיב למען ייטב לך והארכת ימים, וממילא הוא בטוח מנזק ואינו זקוק לעשות מעקה--על זה בא הכתוב לפרש, כי אף אמנם אתה אינך צריך לשמירה זו, אבל אפשר שיפול הנופל ממנו, זה שראוי ליפל, והוי זה בכלל ולא תשים דמים בביתך. --ברוך הלוי עפשטיין, תוספת ברכה, דברים כב:ח >Chassidic master Rabbi Mendel of Kotzk once referred to a certain rabbi as ah tzaddik in peltz — "a righteous person in a fur coat." > The Kotzker explained: When it is winter and it's freezing cold, there are two things one can do. One can build a fire, or one can wrap oneself in a fur coat. In both cases, the person is warm. But when one builds a fire, all who gather round will also be warmed. With the fur coat, the only one who is warmed is the one who wears the coat. > So it is regarding spiritual warmth — one can be a tzaddik in a fur coat... --Shoshannah Brombacher, [_A Tzaddik in a Fur Coat_](https://www.chabad.org/library/article_cdo/aid/258534/jewish/A-Tzaddik-in-a-Fur-Coat.htm) The lesson of כי יפל הנפל is that we can't just be צדיקים by ourselves; we have to care about others.
