This week's parasha starts with the laws of the כהן, and ends with the laws of יום טוב. In between there's a paragraph: <blockquote lang=he><p><b>כו</b> וידבר ה׳ אל משה לאמר׃ <b>כז</b> שור או כשב או עז כי יולד והיה שבעת ימים תחת אמו; ומיום השמיני והלאה ירצה לקרבן אשה לה׳׃ <b>כח</b> ושור או שה אתו ואת בנו לא תשחטו ביום אחד׃ <b>כט</b> וכי תזבחו זבח תודה לה׳ לרצנכם תזבחו׃ <b>ל</b> ביום ההוא יאכל לא תותירו ממנו עד בקר; אני ה׳׃ <b>לא</b> ושמרתם מצותי ועשיתם אתם; אני ה׳׃ <b>לב</b> ולא תחללו את שם קדשי ונקדשתי בתוך בני ישראל; אני ה׳ מקדשכם׃ <b>לג</b> המוציא אתכם מארץ מצרים להיות לכם לאלקים; אני ה׳׃ </p> <footer class=source>ויקרא פרק כב</footer></blockquote> There are 3 commandments here (שבעת ימים תחת אמו,‎ אתו ואת בנו לא תשחטו ביום אחד and ביום ההוא יאכל). Then there's an apparently more general statement of ולא תחללו את שם קדשי ונקדשתי בתוך בני ישראל. Ibn Ezra says that the פשט is that the חלול and קידוש are all about the קרבנות, which is why it's here. <blockquote lang=he><p>וטעם ולא תחללו את שם קדשי עם בני אהרן ידבר כי הפרשה דבקה. והם המצווים שלא ישחטו להם, או לישראל אם ובן ביום אחד. גם יתכן שמצוה וכי תזבחו זבח תודה לכהנים </p> <footer class=source>אבן עזרא, ויקרא כב:לב </footer></blockquote> But that's not how חז״ל understood it. נקדשתי בתוך בני ישראל is a separate מצוה, the idea of מסירת נפש, martyrdom: <blockquote lang=he><p> ולא תחללו שומע אני ממשמע שנאמר ולא תחלל אמור קדש. וכשהוא אומר ונקדשתי מסור את עצמך וקדש שמי . יכול ביחידי תלמוד לומר בתוך בני ישראל המרובים. </p> <footer class=source>ספרא אמור פרשה ט:ד</footer></blockquote> <blockquote lang=he><p><b>א</b> כל בית ישראל מצווין על קידוש השם הגדול הזה שנאמר ”ונקדשתי בתוך בני ישראל“ (ויקרא כב:לב); ומוזהרין שלא לחללו שנאמר ”ולא תחללו את שם קודשי“ (שם)׃ כיצד בשעה שיעמוד גוי ויאנוס את ישראל לעבור על אחת מכל מצוות האמורות בתורה או יהרגנו יעבור ואל ייהרג; שנאמר במצוות ”אשר יעשה אותם האדם וחי בהם“ (ויקרא יח:ה) ולא שימות בהם׃ ואם מת ולא עבר הרי זה מתחייב בנפשו.</p> <p><b>ב</b> במה דברים אמורים בשאר מצוות חוץ מעבודה זרה וגילוי עריות ושפיכות דמים. אבל שלוש עבירות אלו אם יאמר לו עבור על אחת מהן או תיהרג ייהרג ואל יעבור.</p> <p><b>ג</b> במה דברים אמורים בזמן שהגוי מתכוון להנאת עצמו כגון שאנסו לבנות לו ביתו בשבת או לבשל לו תבשילו או אנס אישה לבועלה וכיוצא בזה. אבל אם נתכוון להעבירו על המצוות בלבד אם היה בינו לבין עצמו ואין שם עשרה מישראל יעבור ואל ייהרג; ואם אנסו להעבירו בעשרה מישראל ייהרג ואל יעבור ואפילו לא נתכוון להעבירו אלא על מצוה משאר מצוות בלבד.</p> <footer class=source>משנה תורה, הלכות יסודי התורה פרק ה</footer></blockquote> It's important to note that there are two different imperatives here. The "big three" are ייהרג ואל יעבור even if no one will ever know. קידוש השם is only a public declaration, that obeying G-d's will is more important than life itself. <blockquote lang=he><p>א״ר ישמעאל מנין שאם אמרו לו לאדם עבוד (עבודת כוכבים) [עבודה זרה] ואל תהרג מנין שיעבוד ואל יהרג ת"ל (ויקרא כב) וחי בהם ולא שימות בהם. יכול אפילו בפרהסיא? תלמוד לומר (ויקרא כ) ולא תחללו את שם קדשי ונקדשתי. אינהו דאמור כר״א; דתניא ר״א אומר (דברים ו) ואהבת את ה׳ אלקיך בכל לבבך ובכל נפשך ובכל מאדך.</p> <footer class=source>סנהדרין עד,א</footer></blockquote> <hr/> So what's the connection with rest of the paragraph? I haven't seen anyone deal with this directly, but the Meshech Chochma puts the other mitzvot together: <blockquote lang=he><p>הוא נתן ביסודי תורתו חמלה וחנינה על נפש האדם בלי הפוגה...הבהמה, שלא לצערה, ואם נאכל בשרה, לא האכל בלי חמלה, אלא באופנים שונים אשר ממעטים צערה...ושלא להקריב בעודו יונק בתוך שבעה ”תחת אמו“...ושלא לשחוט אותו ובנו ביום אחד.</p> <footer class=source>משך חכמה, ויקרא כב:כו-לב</footer></blockquote> Rav Kaminetzky adds that the law of פיגול also fits this pattern: <blockquote lang=he><p>במדבר לא הותר להם בשר תאוה מכיון שהיו קרובים למשכן, ולפיכך אם הא׳...היה חפץ לאכול בשר היה צריך להקריב קרבן שלמים, ונמצא דבאמת השלמים אינן רק להכשיר הבשר לאכילה...והיינו רחמי שמים, ובקושי התיר להקריב לו בעלי חיים.</p> <footer class=source>אמת ליעקב, אמור כב:כט</footer></blockquote> These are laws of sacrifices and slaughtering that are meant to keep us from becoming too cruel, too inured to the thought of death: <blockquote lang=he><p>וכן מה שאמרו (ברכות לג) לפי שעושה מדותיו של הקב״ה רחמים ואינן אלא גזרות לומר שלא חס הא־ל על קן צפור ולא הגיעו רחמיו על אותו ואת בנו שאין רחמיו מגיעין בבעלי הנפש הבהמית למנוע אותנו מלעשות בהם צרכנו שאם כן היה אוסר השחיטה אבל טעם המניעה ללמד אותנו מדת הרחמנות ושלא נתאכזר כי האכזריות תתפשט בנפש האדם כידוע בטבחים שוחטי השורים הגדולים והחמורים שהם אנשי דמים זובחי אדם אכזרים מאד ומפני זה אמרו (קידושין פב) טוב שבטבחים שותפו של עמלק והנה המצות האלה בבהמה ובעוף אינן רחמנות עליהם אלא גזירות בנו להדריכנו וללמד אותנו המדות הטובות…</p> <footer class=source>רמב״ן, דברים כב:ו ד״ה כי יקרא קן צפור לפניך</footer></blockquote> And this is important. It's too easy to see the violence of slaughter as an inherent part of worship: <blockquote lang=he><p>...ידוע שענייני עבודה זרה היו להונות לצורות המשפיעות במסירת נפשם, ובשרפת בניהם ובנותיהם...הכלל--להרבות אכזריות...בנפש האדם</p> <footer class=source>משך חכמה, ויקרא כב:כו-לב</footer></blockquote> I think this sequence of מצוות is to teach us about קידוש השם and מסירת נפש. It is a warning not to let it turn into human sacrifice. מסירת נפש is sometimes required but it has to be clear that the result will be a קידוש השם. It's a very short distance between giving up ones life על קידוש השם and suicide bombing. <blockquote lang=he><p>והישמרו, בני, שלא להורות דבר אכזריות בזה; אלא ” ושמרתם מצותי ועשיתם אתם... ולא תחללו את שם קדשי“--ששמו הטוב מורה על היותו מהווה ומחיה העולמים ורצה בקיומם ואינו חפץ בהשחתת בריותו, חלילה, לחלל שמו הטוב והקדוש.</p> <footer class=source>משך חכמה, ויקרא כב:כו-לב</footer></blockquote> If I may over-read Rashi: <blockquote lang=he><p>וכשהוא מוסר עצמו, ימסור עצמו על מנת למות, שכל המוסר עצמו על מנת הנס, אין עושין לו נס.</p> <footer class=source>רש׳י, ויקרא כב:לב, ד״ה ולא תחללו</footer></blockquote> He of course means that one should not be מוסר עצמו planning on being saved by a miracle, but נס also means a banner, a flag to rally around. I think that מסירת נפש על מנת הנס, martyrdom with the intention of inspiring others, is doomed to failure. Our aim should be to live על קידוש השם, not to die על קידוש השם. <hr/> As Rav Lichtenstein says, we need to care how others see us, as long as <em>their</em> standards are those that we share: <blockquote lang="en"><p> In some instances, those whose reaction we anticipate come from an entirely different frame of reference from ours; their ethics and standards differ fundamentally from ours. Given the different values and different outlooks, they will react to us with harsh criticism. What they consider a virtue to us has no importance and at times we even look upon it as a negative value. For example, an ideological supporter of permissiveness will sharply criticize the world of halakha, which constricts and binds a person’s actions at every step…This type of criticism, which is perhaps accompanied to some extent by “what the Egyptians say”—“Egypt” here serving as the archetype for the general, secular world, represents one sort of problem that can involve a chillul Hashem.</p> <p>But there arises an entirely different sort of problem: criticism issued out of a proper moral perspective, whose basic assumptions we share, but the impression created is wrong and misleading. In such a situation, we must certainly concern ourselves with “what the Egyptians will say” and the chillul Hashem involved. As the yardsticks forming the basis of the criticism are the correct ones—justice, uprightness, truth and morality, we must afford it significance.</p> … <p>[T]he sanctification of the Name, or, Heaven forbid, its desecration, involves more than positive or negative publicity, the creation of an impression, building a popular image for the Almighty, His world and His values. Kiddush Hashem means affecting the very essence of that “Shem” (Name), which, as it were, contracts or expands according to our behavior.</p> … <p>[W]e must understand that all this entails something we may view as revolutionary or daring: we, human beings, determine, as it were, the status of God’s Name in the world.</p> <p>This points to the immense power given to man. The person living within a physical body is capable of affecting G-d’s Name, to detract from it, to damage it, or to expand it and deepen it.</p> <footer class="source"><a href="http://etzion.org.il/en/kiddush-hashem-sanctifying-gods-name-part-2">Rav Aharon Lichtenstein, <cite>Kiddush Hashem: Sanctifying G-d’s Name</cite>, part 2</a></footer></blockquote> <hr/> To end, I would like add a wonderful quote from David Weiss Halivni. He resigned from JTS when they voted to give women rabbinic ordination. His opposition was not so much with the conclusion, but with the process. There was no halachic decision-making, no looking to Jewish sources and tradition. The result was decided, then the justifications were invented. He sacrificed his career על קידוש השם. <blockquote lang=en><p>Even to strengthen tradition, one must proceed traditionally. Otherwise it is a <i lang=he>mitzvah haba'ah ba'aveirah</i>--a mitzvah performed by means of a transgression.</p> <p>It is my personal tragedy that the people I daven with, I cannot talk to, and the people I talk to, I cannot daven with. However, when the chips are down, I will always side with the people I daven with; for I can live without talking.
