Thoughts on Tanach and the Davening

This week’s parsha emphasizes the role of the כהן in diagnosing צרעת:

א וידבר ה׳ אל משה ואל אהרן לאמר׃ ב אדם כי יהיה בעור בשרו שאת או ספחת או בהרת והיה בעור בשרו לנגע צרעת והובא אל אהרן הכהן או אל אחד מבניו הכהנים׃

ויקרא פרק יג

…הכל כשרים לראות את הנגעים, אלא שהטמאה והטהרה בידי כהן. אומרים לו אמר טמא, והוא אומר טמא. אמר טהור, והוא אומר טהור.

משנה נגעים ג:א

הכל כשרים לראות את הנגעים: ואע״פ שאינו בקי בהן ובשמותיהן, אם חכם עמו, רואה. אבל בינו לבין עצמו אם אינו בקי בהן ובשמותיהן אינו רואה את הנגעים.

שהטומאה והטהרה ביד כהן: חכם ישראל רואה את הנגעים ואומר לכהן, אע״פ שהוא שוטה, אמור טמא, אמור טהור.

What’s odd about this is that it is a legal section that comes in the middle of the narrative about the opening ceremonies of the משכן:

א ויקחו בני אהרן נדב ואביהוא איש מחתתו ויתנו בהן אש וישימו עליה קטרת; ויקריבו לפני ה׳ אש זרה אשר לא צוה אתם׃ ב ותצא אש מלפני ה׳ ותאכל אותם; וימתו לפני ה׳׃

ויקרא פרק י

א וידבר ה׳ אל משה אחרי מות שני בני אהרן בקרבתם לפני ה׳ וימתו׃ ב ויאמר ה׳ אל משה דבר אל אהרן אחיך ואל יבא בכל עת אל הקדש מבית לפרכת אל פני הכפרת אשר על הארן ולא ימות כי בענן אראה על הכפרת׃

ויקרא פרק טז

So we have 5 perakim of halachic instructions that could have been put anywhere, but interrupt the narrative of the dedication of the משכן. I would assume that these laws are inherent to what being a כהן is.

My model for the chronology of מתן תורה is that Moshe comes down from הר סיני (with the second לוחות) and spends the next 6 months (while the craftsmen are building the משכן) teaching everyone the תורה that he had learned:

ל וירא אהרן וכל בני ישראל את משה והנה קרן עור פניו; וייראו מגשת אליו׃ לא ויקרא אלהם משה וישבו אליו אהרן וכל הנשאים בעדה; וידבר משה אלהם׃ לב ואחרי כן נגשו כל בני ישראל; ויצום את כל אשר דבר ה׳ אתו בהר סיני׃ לג ויכל משה מדבר אתם; ויתן על פניו מסוה׃ לד ובבא משה לפני ה׳ לדבר אתו יסיר את המסוה עד צאתו; ויצא ודבר אל בני ישראל את אשר יצוה׃

And these laws were reviewed as a kind of refresher course, aimed specifically at the כהנים. It starts with last week’s parsha, with the laws of כשרות:

א וידבר ה׳ אל משה ואל אהרן לאמר אלהם׃ ב דברו אל בני ישראל לאמר; זאת החיה אשר תאכלו מכל הבהמה אשר על הארץ׃

ויקרא פרק יא

אל משה ואל אהרן: למשה אמר שיאמר לאהרן.

לאמר אלהם: אמר שיאמר לאלעזר ולאיתמר; או אינו אלא לאמר לישראל? כשהוא אומר דברו אל בני ישראל הרי דבור אמור לישראל, הא מה אני מקים לאמר אלהם? לבנים—לאלעזר ולאיתמר.

רש״י, ויקרא יא:א

Those 5 perakim are the laws of כשרות, childbirth, צרעת and זב. What do they have in common? Rabbi Leibtag suggests that they all fundamentally deal with טומאה and טהרה, and טומאה cannot enter the מקדש. So after the sin of נדב and אביהו, which (however we understand it) involved being in the wrong place at the wrong time in the מקדש, Moshe reviews the rules for not going into the מקדש. However, missing from our collection of laws is the אב הטומאה itself, טומאת מת (that won’t be recorded until פרשת חקת). And the problem with נדב and אביהו was not one of טומאה!


So I’m going to propose a different answer, based on פרשת שמיני תש״פ.‎ כהנים come up in an interesting place in the halacha:

א כי ימצא חלל באדמה אשר ה׳ אלקיך נתן לך לרשתה נפל בשדה; לא נודע מי הכהו׃ ב ויצאו זקניך ושפטיך; ומדדו אל הערים אשר סביבת החלל׃…ה ונגשו הכהנים בני לוי כי בם בחר ה׳ אלקיך לשרתו ולברך בשם ה׳; ועל פיהם יהיה כל ריב וכל נגע׃

דברים פרק כא

על פיהם יהיה כל ריב וכל נגע? We know about the role of the כהן in נגעים (that’s our parsha). But what do they have to do with ריב, arguments, legal issues? It seems that the כהנים had two roles:

ח וללוי אמר תמיך ואוריך לאיש חסידך אשר נסיתו במסה תריבהו על מי מריבה׃ …י יורו משפטיך ליעקב ותורתך לישראל; ישימו קטורה באפך וכליל על מזבחך׃

דברים פרק לג

יורו משפטיך ליעקב: מלמד שכל ההוראות אינם יוצאות אלא מפיהם שנאמר ועל פיהם יהיה כל ריב וכל נגע.

ילקוט שמעוני תורה פרשת וזאת הברכה רמז תתקנה

יורו משפטיך ליעקב: שיפוצו בכל ישראל ללמד תורה. וכן אמר יעקב (בראשית מט:ז) ואפיצם בישראל.

And the Torah says that the כהן had a role in judgment:

ט ובאת אל הכהנים הלוים ואל השפט אשר יהיה בימים ההם; ודרשת והגידו לך את דבר המשפט׃ י ועשית על פי הדבר אשר יגידו לך מן המקום ההוא אשר יבחר ה׳; ושמרת לעשות ככל אשר יורוך׃

I think it goes back to an interesting comment in the gemara:

אמר רב פפא, הכי קאמר: נגעים—מקרא מרובה והלכות מועטות, אהלות—מקרא מועט והלכות מרובות. ומאי נפקא מינה? אי מסתפקא לך מילתא בנגעים—עיין בקראי, ואי מסתפקא לך מילתא באהלות—עיין במתניתין.

חגיגה יא,א

The כהנים were the keepers of the תורה שבכתב.

כה ויצו משה את הלוים נשאי ארון ברית ה׳ לאמר׃ כו לקח את ספר התורה הזה ושמתם אתו מצד ארון ברית ה׳ אלקיכם; והיה שם בך לעד׃

Rav Naftali Bar-Ilan (grandson of Rav Meir Bar Ilan, great grandson of the Netziv) that this was the role of the כהנים: to preserve the text, to be the carriers of tradition, not just in ritual, but in תלמוד תורה as well:

ניתן לפרש את הפסוק בדרך נוספת. אם יפלא מבית דין שבעיר דבר הקשור לנוסח המקרא—”ובאת אל הכהנים הלוים“, שהם מופקדים על שמירת תורה שבכתב והוראתה [ראה דברים לא:ט] והם יבררו את הנוסח המדויק על פי הספר המונח בעזרה. וראה מלכים ב כב:ח, וַיֹּאמֶר חִלְקִיָּהוּ הַכֹּהֵן הַגָּדוֹל עַל שָׁפָן הַסֹּפֵר סֵפֶר הַתּוֹרָה מָצָאתִי בְּבֵית ה׳… וראה בבלי חגיגה יא,א: ”אי מסתפקא לך מילתא בנגעים עיין בקראי“, ומובן מפני מה גזרה התורה שדוקא כהנים רואים נגעים…ואם יפלא מדייני העיר דבר הקשור לתורה שבע״פ, עליהם לפנות ”ואל השפט אשר יהיה בימים ההם“, היינו אל בית הדין הגדול.

But it’s not just the text of the תורה שבכתב. The כהנים are the keepers of the מסורה of the תורה שבעל פה. When we use the term תורה שבעל פה, we are referring to two different things.

The halakhic order comprises three distinct tiers. There is, first, an ideal, and presumably monistic, plane, the Torah which is ba-shamayyim…There is, as the final stage, the definitive corpus, the genre of the Shulhan Arukh, which, having decided among various views, posits—again, monistically—what is demanded of the Jew. Intermediately, however, there is the vibrant and entrancing world within which exegetical debate and analytic controversy are the order of the day, and within which divergent and even contradictory views are equally accredited. [T]he results all attain the status of Torah, as a tenable variant reading of devar Hashem: “Both these and those are words of the living God.”

The כהן represents the people to G-d in the עבודה, and represents G-d to the people in הוראה. The כהן is the keeper of the authentic תורה שבכתה, and the voice of the original תורה שבעל פה (what Rav Lichtenstein calls the ideal Torah which is ba-shamayyim), as opposed to the human-derived תורה שבעל פה that is the חידושים of every generation.

There is a dialectic inherent in our understanding of Torah, between innovation and conservatism. An important part of Torah is what we as human beings bring into it:

ותורה שבעל פה היא משחדשו חכמי ישראל וכנסת ישראל על ידי השגת לבם ומוחם מרצון השי״ת, והוא ההשגה שחלק להם השי״ת כפי צמצום לבם ומוחם.

But there is equally a place to say “this is what is was, this is what it always will be”.

[A conservative is one who] stands athwart history, yelling Stop.

But Priests have a different role altogether. They inhabit a world that is timeless, ahistorical, in which nothing significant changes. The daily, weekly and yearly sacrifices were always the same. Every element of the service of the Tabernacle was bound by its own detailed rules, and nothing of significance was left to the discretion of the Priest.

The Priest was the guardian of order.

The priestly vocation was to remind the people that there are limits. There is an order to the universe and we must respect it. Spontaneity has no place in the life of the Priest or the service of the Sanctuary. That is what Nadav and Avihu failed to honour. It might have seemed like a minor transgression but it was in fact a negation of everything the Tabernacle and the Priesthood stood for.

כשרות,‎ צרעת, the laws of טומאה and טהרה, are less about figuring things out and more about מסורה, a continuous tradition that this is how things are done (please don’t ask me about turkeys!). Our parsha reminds us that we can’t be enthralled with our own cleverness; our goal is to achieve the רצון ה׳ that remains, tantalizingly out of reach, בשמים.
