This week's parasha is part of the long series of mitzvot that Moshe reviews. There's a one-liner that I want to focus on today: <blockquote lang=he><p>כי תבנה בית חדש ועשית מעקה לגגך; ולא תשים דמים בביתך כי יפל הנפל ממנו׃</p> <footer class=source>דברים כב:ח</footer></blockquote> Taken literally, this is a strangely specific law, and the halacha takes it as an archetype, a בנין אב, for what we might call municipal codes: <blockquote lang=he><p>רבי נתן אומר: מניין שלא יגדל אדם כלב רע בתוך ביתו ואל יעמיד סולם רעוע בתוך ביתו: ת״ל ”לא תשים דמים בביתך“.</p> <footer class=source>בבא קמא טו,ב</footer></blockquote> <blockquote lang=en><p>More than a dozen rabbis from the city of Elad near Tel Aviv issued an edict declaring all dogs bad and warning residents that keeping them will make them accursed.</p> <p>“We have heard and have seen that lately, a serious phenomenon has spread in our city Elad, in which young boys and children walk around publicly with dogs. This is strictly forbidden. As explained in the Talmud and by the Rambam, anyone raising a dog is accursed and especially in our city where many women and children are afraid of dogs,” the anti-canine edict states.</p> <p>The rabbi of neighboring Holon, Avraham Yosef, is quoted as writing: “I do not find any grounds for permitting any dog whatsoever in any manner.”</p> <p>The term “bad dog” means “any dog, for it barks on whomever it does not know and because of its bark it is a bad dog even if does not bite,” the edict also states. People who keep dogs for medical needs should appear before the local rabbinical court so it may rule on their matter, the edict says.</p> <footer class=source><a href="https://www.jta.org/2019/07/12/israel/all-dogs-are-bad-and-their-owners-are-accursed-rabbis-in-israel-rule">JTA, <cite>All dogs are bad and their owners accursed, Israeli city’s rabbis rule</cite></a></footer></blockquote> But why this particular example? Rashi addresses another question, one of context. We'e talked about the mitzvot of ספר דברים being organized as an expansion of the 10 commandments; this section is about לא תנאף: the sanctity of marriage, extended to the sanctity of family, even respecting maternal instincts (שלוח הקן). But then why guardrails? <blockquote lang=he><p><em>כי תבנה בית חדש</em>: אִם קִיַּמְתָּ מִצְוַת שִׁלּוּחַ הַקֵּן, סוֹפְךָ לִבְנוֹת בַּיִת חָדָשׁ, וּתְקַיֵּם מִצְוַת מַעֲקֶה, שֶׁמִּצְוָה גּוֹרֶרֶת מִצְוָה, וְתַגִּיעַ לְכֶרֶם וְשָׂדֶה וְלִבְגָדִים נָאִים, לְכָךְ נִסְמְכוּ פָּרָשִׁיּוֹת הַלָּלוּ.</p> <footer class=source>רש״י, דברים כב:ח</footer></blockquote> That doesn't quite answer the question why this specific mitzvah. Ibn Ezra alludes to the fact that Moshe is addressing a generation of people who have never even seen a roof. This mitzvah is part of the message that they are entering a land to settle and establish a society: <blockquote lang=he><p><b>ח</b> <em>כי תבנה בית חדש</em>: נדבקה זאת הפרשה אחר שנלחמו והם בארץ החל במצות הבית</p> <b>ט</b> ואחר מצות הבית מצות הזרע והנטע כי אחר שהוא בארץ ובנה בית יזרע. <footer class=source>אבן עזרא, דברים פרק כב</footer></blockquote> It's not one of the מצוות תלויות בארץ but it is dependent on being in the land, and the need to establish building codes is part of what it means to create a civil society. More than that, establishing a society means that we cannot live in isolation,that we are responsible for each other: <blockquote lang=he><p>לא ענש את הרבים עד שעברו את הירדן משקבלו עליהם את השבועה בהר גרזים ובהר עיבל ונעשו ערבים זה לזה.</p> <footer class=source>רש״י, דברים כט:כח</footer></blockquote> It is an extension of the sanctity of family life to respect the sanctity of civil life. <hr/> There's another subtlety about this halacha: כי יפל הנפל. The victim is not a נופל; the goal is that they not be a נופל at all. <blockquote lang=he><p><em>הנופל</em>: נקרא על שם סופו. וכן (דברים יז:ו) יוּמַת הַמֵּת...(בראשית כה:כב) וַיִּתְרֹצֲצוּ הַבָּנִים ומלות רבות לאין מספר נקראו על שם סופם. ולא נדע אם כן דרך הלשון או הוא דברי נבואה...</p> <footer class=source>אבן עזרא,דברים כב:ח</footer></blockquote> Grammatically, this is called "proleptic", which I found out from an interesting article about being toast: <blockquote lang=en><dl> <dt>prolepsis</dt><dd>Anticipation, such as the representation or assumption of a future act or development as if presently existing or accomplished.</dd> </dl> <footer class=source><a href="https://www.merriam-webster.com/dictionary/prolepsis">Merriam-Webster, <cite>prolepsis</cite></a></footer></blockquote> <blockquote lang=en><p>(1983) D. Aykroyd & H. Ramis, <cite>Ghostbusters</cite> (film script, third draft), p. 123. Venkman...: Okay. That’s it! I’m gonna turn this guy into toast.</p> <p>The lines in quot. 1983 do not in fact appear in the U.S. film <cite>Ghostbusters</cite> as released in 1985, since a considerable amount of the dialogue is ad-libbed. The actual words spoken by Venkman (played by Bill Murray) as he prepares to fire a laser-type weapon, are, ‘This chick is toast’; this is probably the origin of the proleptic construction which has gained particular currency</p> <footer class=source>Oxford English Dictionary, <cite>Toast</cite> (as cited by <a href="https://althouse.blogspot.com/2019/07/i-had-to-look-up-susan-collins-is-toast.html">Ann Althouse</a>)</footer></blockquote> In the Torah, the use is more than grammatical, as Ibn Ezra hints, הוא דברי נבואה: <blockquote lang=he><p><em>כי יפל הנפל</em>: רָאוּי זֶה לִפֹּל, וְאַעַ״פִּ כֵן לֹא תִתְגַּלְגֵּל מִיתָתוֹ עַל יָדְךָ, שֶׁמְּגַלְגְּלִין זְכוּת עַל יְדֵי זַכַּאי וְחוֹבָה עַל יְדֵי חַיָּב.</p> <footer class=source>רש״י, דברים כב:ח</footer></blockquote> And the gemara puts it even more strongly: <blockquote lang=he><p>תנא דבי רבי ישמעאל: ”כי יפול הנופל ממנו“: ראוי זה ליפול מששת ימי בראשית שהרי לא נפל והכתוב קראו נופל אלא שמגלגלין זכות על ידי זכאי וחובה על ידי חייב.</p> <footer class=source>שבת לב,א</footer></blockquote> The idea is that I have to take responsibility. I cannot say, "Everything is determined by G-d. If G-d wants him to fall, he will fall. If not, nothing I will do will change that. Why should I care?". מגלגלין זכות על ידי זכאי. I have to do the right thing, then ה׳ assures me that the right consequences will follow. It's the classic dialectic of השתדלות vs. בטחון. David brings it up when running from Saul: <blockquote lang=he><p><b>ט</b> ויאמר דוד לשאול למה תשמע את דברי אדם לאמר; הנה דוד מבקש רעתך׃ <b>י</b> הנה היום הזה ראו עיניך את אשר נתנך ה׳ היום בידי במערה ואמר להרגך ותחס עליך; ואמר לא אשלח ידי באדני כי משיח ה׳ הוא׃ <b>יא</b> ואבי ראה גם ראה את כנף מעילך בידי; כי בכרתי את כנף מעילך ולא הרגתיך דע וראה כי אין בידי רעה ופשע ולא חטאתי לך ואתה צדה את נפשי לקחתה׃ <b>יב</b> ישפט ה׳ ביני ובינך ונקמני ה׳ ממך; וידי לא תהיה בך׃ <b>יג</b> כאשר יאמר משל הקדמני מרשעים יצא רשע; וידי לא תהיה בך׃</p> <footer class=source>שמואל א פרק כד</footer></blockquote> <blockquote lang="he"><p><em>כאשר יאמר משל הקדמוני</em>: משל קדמונו של עולם, התורה , שהיא משלו של הקב״ה. <em>מרשעים יצא רשע</em>: הקב״ה מזמן לרשע , שנופל ביד רשע כיוצא בו , והיכן אמרה תורה (שמות כא:יג): והאלקים אנה לידו כדאיתא במסכת מכות (י,ב). </p> <footer class="source">רש״י, שמואל א כד:יד</footer></blockquote> <blockquote lang=he><p>ר״ש בן לקיש פתח לה פתחא להאי פרשתא מהכא (שמות כא:יג) וַאֲשֶׁר לֹא צָדָה וְהָאֱלֹקִים אִנָּה לְיָדוֹ וגו׳: ”כאשר יאמר משל הקדמוני מרשעים יצא רשע וגו׳“. במה הכתוב מדבר? בשני בני אדם שהרגו את הנפש אחד הרג בשוגג ואחד הרג במזיד, לזה אין עדים ולזה אין עדים. הקב״ה מזמינן לפונדק אחד; זה שהרג במזיד יושב תחת הסולם וזה שהרג בשוגג יורד בסולם ונפל עליו והרגו. זה שהרג במזיד נהרג וזה שהרג בשוגג גולה.</p> <footer class=source>מכות י,ב</footer></blockquote> But that's not our job. In our relationship with others, we effectively have to deny ה׳'s השגחה. We've cited several times the famous saying attributed to the Baal Shem Tov: <blockquote lang=he><p>ושאלו להבעש״ט ז״ל הא דילתא בחולין קט,א: כל מה דאסר שרי כנגדו…באיזה אופן מותר כפירה? והשיב בצדקה לא תאמר לעני שיהיה לו בטחון ובודאי יעזור לו ה׳; רק תהיה כופר באותו שעה, ותעשה לו כל מה שבידך…</p> <footer class=source>פרדס יוסף, תרומה כה</footer></blockquote> <hr/> So one little law teaches us about what the Torah has to say about theology, theodicy, society and mutual responsibility.
