I want to talk about one of the most difficult מצוות in this week's parasha: <blockquote lang=he><p><b>יח</b> כי יהיה לאיש בן סורר ומורה איננו שמע בקול אביו ובקול אמו; ויסרו אתו ולא ישמע אליהם׃ <b>יט</b> ותפשו בו אביו ואמו; והוציאו אתו אל זקני עירו ואל שער מקמו׃ <b>כ</b> ואמרו אל זקני עירו בננו זה <em>סורר ומרה איננו שמע בקלנו; זולל וסבא</em>׃ <b>כא</b> ורגמהו כל אנשי עירו באבנים ומת ובערת הרע מקרבך; וכל ישראל ישמעו ויראו׃</p> <footer class=source>דברים פרק כא</footer></blockquote> What has this child done wrong? (and he is a child, called בן, under his parent's jurisdiction, though he has to be over bar mitzvah to be liable. The halacha specifies that he has to be from Tanner 2 to Tanner 4; as a practical matter from 13 to 13 and 3 months). <blockquote lang=he><p>סורר על דברי אביו, ומורה על דברי אמו. סורר על דברי תורה, ומורה על דברי הנביאים. סורר על דברי עדים, ומורה על דברי דיינים. </p> <footer class=source>ספרי דברים פרשת כי תצא פיסקא ריח </footer></blockquote> <blockquote lang=he><p>מאימתיי הוא חייב: משיאכל טרמיטר בשר, וישתה חצי לוג יין באיטלקי; רבי יוסי אומר, מנה בשר, ולוג יין...אכל כל מאכל ולא אכל בשר, שתה כל משקה ולא שתה יין--אינו נעשה בן סורר ומורה, עד שיאכל בשר, וישתה יין--שנאמר ”זולל, וסובא“ (דברים כא:כ). אף על פי שאין ראיה לדבר, זכר לדבר, ”אל תהי בסובאי יין בזוללי בשר למו“ (משלי כג:כ).</p> <footer class=source>משנה סנהדרין ח,ב</footer></blockquote> <blockquote lang=he><p>והנה יש עליו שני עונשין, האחד שהוא מקלה אביו ואמו וממרה בהם, והשני שהוא זולל וסובא עובר על מה שנצטוינו (ויקרא יט:ב) קדושים תהיו. </p> <footer class=source>רמב״ן, דברים כא:יח </footer></blockquote> <blockquote lang=he><p>והענין כי התורה הזהירה בעריות ובמאכלים האסורים והתירה הביאה איש באשתו ואכילת הבשר והיין, א״כ ימצא בעל התאוה מקום להיות שטוף בזמת אשתו או נשיו הרבות, ולהיות בסובאי יין בזוללי בשר למו, וידבר כרצונו בכל הנבלות, שלא הוזכר איסור זה בתורה, והנה יהיה נבל ברשות התורה.</p> <p>לפיכך בא הכתוב, אחרי שפרט האיסורים שאסר אותם לגמרי, וצוה בדבר כללי שנהיה פרושים מן המותרות. ימעט במשגל...ויקדש עצמו מן היין במיעוטו...וגם ישמור פיו ולשונו מהתגאל ברבוי האכילה הגסה ומן הדבור הנמאס...עיקר הכתוב בכיוצא בזה יזהיר, שנהיה נקיים וטהורים...</p> <footer class=source>רמב״ן, ויקרא יט:ב </footer></blockquote> The Ramban notes that his fundamental sin is not the disobedience but the lack of sense. He is a נבל ברשות התורה and willfully continues at it. The Torah basically says that he is irredeemable (as Rashi puts it, הגיעה תורה לסוף דעתו) for that. It's an interesting perspective. What would bother us more, if our child violated Shabbat or if they smoked? Which would make us despair? <hr/> <blockquote lang=he><p><b>י</b> כיצד דנין בן סורר ומורה? מביאין אותו אביו ואימו תחילה לבית דין של שלושה ואומרין להן ”בננו זה סורר ומורה“ ומביאין שני עדים שגנב משל אביו וקנה בשר ויין במה שגנב ואכל אותם אכילה האמורה אחר ההתראה; וזו היא עדות הראשונה׃ ומלקין אותו כשאר מחוייבי מלקות שנאמר ”וייסרו אותו ולא ישמע אליהם“.</p> <p><b>יא</b> חזר וגנב משל אביו ואכל אכילה זו, אביו ואימו מביאין אותו לבית דין של עשרים ושלושה ומביאין שניים ומעידין עליו שגנב ואכל אכילה זו האמורה אחר שהתרו בו...גומרין דינו כדרך כל הרוגי בית דין וסוקלין אותו.</p> <footer class=source>משנה תורה, הלכות ממרים פרק ז</footer></blockquote> <hr/> The mishna refers to chapter 23 of Mishlei to define זולל וסבא. I will seek it yet again.”</p> <footer class=source>Proverbs Chapter 23</footer></blockquote> </figure> I would interpret this perek to be addressed to the child (בני). Psukim יב-יג are quotes of what advice the father got: אַתָּה בַּשֵּׁבֶט תַּכֶּנּוּ, a reference to ויסרו אתו, the first step of the בן סורר ומורה process. The warning is against being בְסֹבְאֵי יָיִן and בְּזֹלְלֵי בָשָׂר. The effects of wine are graphically described (עֵינֶיךָ יִרְאוּ זָרוֹת,‎ כְּשֹׁכֵב בְּלֶב יָם) along with the dangers of addiction (מָתַי אָקִיץ; אוֹסִיף אֲבַקְשֶׁנּוּ עוֹד). But the זֹלְלֵי בָשָׂר is associated not with literal gluttony but with the זוֹנָה and נָכְרִיָּה; it's a warning against ערוה. Perhaps this is why the mishna says אף על פי שאין ראיה לדבר, זכר לדבר. <hr/> Still the moral difficulty of punishing a child for their future sin remains. The halacha acknowleges this by making the actual punishment impossible: <blockquote lang=en><p>In fact, the whole tendency of rabbinic interpretation was so restrictive as to make it difficult if not impossible for such a case to arise. The child must be within three months of attaining maturity (younger than that, he was still a minor; older, he was not still a child). He must have stolen money from his parents, used it to buy a specific measure of meat and Italian wine, eaten and drunk it in one go, in a place other than his parent’s house, and so on. The conditions that had to be satisfied for the law to be applied were so stringent that they could almost never have been met. Indeed some sages suggested conditions that in practice would never be fulfilled. For example, R. Judah held that “If his mother is not like his father in voice, appearance and stature, he does not become a rebellious son. Why? Because the Torah states, He will not obey our voice, and since they must be alike in voice, they must be alike in appearance and stature also.”</p> <footer class=source><a href="http://www.rabbisacks.org/ki-tetse-5767-stubborn-and-rebellious-sons/">Rabbi Jonathan Sacks</a>, <cite>Ki Tetse (5767): Stubborn and Rebellious Sons</cite></footer></blockquote> And the gemara says it never happened: <blockquote lang=he><p>דתניא בן סורר ומורה לא היה ולא עתיד להיות ולמה נכתב דרוש וקבל שכר. כמאן? כרבי יהודה; איבעית אימא ר׳ שמעון היא, דתניא: אמר רבי שמעון וכי מפני שאכל זה תרטימר בשר ושתה חצי לוג יין האיטלקי אביו ואמו מוציאין אותו לסקלו? אלא לא היה ולא עתיד להיות ולמה נכתב דרוש וקבל שכר. אמר ר׳ יונתן אני ראיתיו וישבתי על קברו.</p> <footer class=source>סנהדרין עא,א</footer></blockquote> <a href="http://www.torahleadership.org/categories/reeh2016.pdf">Rabbi Aryeh Klapper</a> points out many problems with ר׳ יונתן's comment. First, ר׳ יונתן was a Cohen (I don't have his source for that), and should not have been sitting on a grave. Second, he was an amora, who lived centuries after the Sanhedrin could judge capital cases. So he could not have seen an actual case of בן סורר ומורה being tried. (The Bar Ilan database says that the ר׳ יונתן here was a fourth-generation Tanna, who was not a Cohen. He still could not have seen a capital case). Third, simply seeing an old grave of a בן סורר ומורה doesn't mean the halacha was correctly applied; the only actual case in recorded history is from Josephus, describing how Herod had his sons killed: <blockquote lang=en><p>How Herod, by permission from Caesar accused his sons before and assembly of judges...He also added an allegation of a law of their country, which enjoined this: That if parents laid their hands on the head of him that was accused, the standers by were obliged to cast stones at him, and thereby to slay him...</p> <footer class=source><a href=״http;//www.ccel.org/ccel/josephus/complete.ii.xvii.xi.html״>Josephus, <cite>Antiquities of the Jews</cite>, XVI:11</a></footer></blockquote> But לא היה ולא עתיד להיות means it cannot be applied על פי הלכה. Rabbi Akiva Eiger points out another problem: the halacha forbids sitting on a grave. וישבתי על קברו must be figurative. The Kli Yakar makes a textual point that even the Torah did not expect this to ever happen: <blockquote lang=he><p><b>ז</b> כי יסיתך אחיך בן אמך או בנך או בתך או אשת חיקך או רעך אשר כנפשך בסתר לאמר; נלכה ונעבדה אלהים אחרים אשר לא ידעת אתה ואבתיך׃...<b>יא</b> וסקלתו באבנים ומת; כי בקש להדיחך מעל ה׳ אלקיך המוציאך מארץ מצרים מבית עבדים׃ <b>יב</b> וכל ישראל ישמעו ויראון; <em>ולא יוספו לעשות</em> כדבר הרע הזה בקרבך׃</p> <footer class=source>דברים פרק יג</footer></blockquote> <blockquote lang=he><p><b>יב</b> והאיש אשר יעשה בזדון לבלתי שמע אל הכהן העמד לשרת שם את ה׳ אלקיך או אל השפט ומת האיש ההוא ובערת הרע מישראל׃ <b>יג</b> וכל העם ישמעו ויראו; <em>ולא יזידון עוד</em>׃</p> <footer class=source>דברים פרק יז </footer></blockquote> <blockquote lang=he><p> <b>טז</b> כי יקום עד חמס באיש לענות בו סרה׃ ... <b>יט</b> ועשיתם לו כאשר זמם לעשות לאחיו; ובערת הרע מקרבך׃ <b>כ</b> והנשארים ישמעו ויראו; <em>ולא יספו לעשות עוד</em> כדבר הרע הזה בקרבך׃</p> <footer class=source>דברים פרק יט</footer></blockquote> <blockquote lang=he><p>כי יהיה לאיש - אמרו רז״ל בן סורר ומורה לא היה ולא יהיה, ולמה נכתב בתורה... ואולי טעמו של דבר כדי שישמעו הבנים ויראו ולא יעשו כדבר הזה, ומה שכתב ”וכל ישראל ישמעו“ היינו שישמעו פרשה זו ומשפט הכתוב בה, וייראו הבנים מלמרות עיני כבודם של אב ואם, ולכך לא נאמר ”ולא יזידון עוד“, כי לשון עוד מורה על דבר הנעשה כבר, שלא יהיה נעשה עוד, וזה אינו, שהרי בן סורר ומורה לא היה דברים מעולם... </p> <footer class=source>כלי יקר, דברים כא:כא</footer></blockquote> Then what is ר' יונתן coming to tell us? <blockquote lang=he><p>ולולא דמסתפינא אמינא על פי דברי חז״ל (סנהדרין לז,ב) מיום שחרב בית המקדש אע״פ שבטלה סנהדרין, דין ארבע מיתות לא בטלו. מי שנתחייב סקילה או נופל מן הגג או חיה דורסתו; מי שנתחייב שריפה או נופל בדליקה אן נחש מכישו; מי שנתחייב הריגה וכו׳. וכמו כן, אף שבפועל אי אפשר שתהיה עיר הנדחת, קמ״ל רבי יונתן שדין עיר הנדחת לא בטלה. שפעם מצא תל עיר חריבה ונתברר לו שהיתה עיר שעבדה ע״ז ונחרבה, וזהו אמרו אני ראיתיה וישבתי על תילה. חקר ודרש וידע שאף שלא נידונה ע״י ב״ד, מ״מ דין עיר הנדחת נתקיימה בה. וכן מצא קבר של בן י״ג ונתברר לו שהיה מתנהג לגמרי כבן סורר ומורה, וראה מזה שאף שלא דנו אותו בב״ד, דין בן סורר ומורה לא בטל.</p> <footer class=source>רב שמעון שווב, מעין בית השואבה, כי תצא</footer></blockquote> <blockquote lang=he><p>כי אין לך איסור אחד מאיסורי תורה או רז״ל שלא יהיה נמצא אדם בכל הדורות שעבר עליו. כי השי״ת ציפה מראשית אחרית ואם לא יעבור עליו אד לא היה מזהירו. ומ״ד בסנהדרין (עא,א) בן סורר ומורה ועיר הנדחת לא היה ולא נבראו אידחי מהלכה. וגם לפי דעתו היינו לענין משפט העונש שבתורה יש תנאים ידועים שאין מצוים; לא על גופה של עבירה .</p> <footer class=source>ר׳ צדוק הכהן מלובלין (דובר צדק, עמ׳ 126-127 )</footer></blockquote> So the law is real (and the situation of a rebellious child is certainly real). The mitzvah as described emphasizes how important חינוך is, and we learn many things from the details. And it truly applies to all of us: <blockquote lang=he><p>...אך קשה וכל הבנים היה לו לומר, כי אין צורך לפחד זה כי אם לבנים. ובספר הזוהר דרש פרשה זו על כל ישראל, ואני אומר שאין צורך בזה, כי גם מפשוטה של פרשה יש מוסר נפלא לכל ישראל שנקראו בנים לא־ל חי, ויש לחוש שיסמכו על זה ויאמרו, מאחר שאנחנו בניו, אם כן ודאי אם יהיו בנים סוררים לא יביט און ביעקב וירחם עליהם כרחם אב על בנים ויוותר להם, כדרך שהאב מוותר לבנו... על כן כתבה התורה שהדין דין אמת, שאפילו האב חייב להביא את בנו לבית דין ולמוסרו למיתה, ועל ידי זה ישמעו פרשה זו כל ישראל ויראו את ה׳...</p> <footer class=source>כלי יקר, דברים כא:כא</footer></blockquote>
