Thoughts on Tanach and the Davening

This is largely a re-presentation of פרשת ויקרא תשע״ט. This week’s parsha ends with a description of the קרבן אשם, the sacrifice that is brought when one commits a monetary crime and lies about it under oath:

כא נפש כי תחטא ומעלה מעל בה׳; וכחש בעמיתו בפקדון או בתשומת יד או בגזל או עשק את עמיתו׃ כב או מצא אבדה וכחש בה ונשבע על שקר; על אחת מכל אשר יעשה האדם לחטא בהנה׃ כג והיה כי יחטא ואשם והשיב את הגזלה אשר גזל או את העשק אשר עשק או את הפקדון אשר הפקד אתו; או את האבדה אשר מצא׃ כד או מכל אשר ישבע עליו לשקר ושלם אתו בראשו וחמשתיו יסף עליו; לאשר הוא לו יתננו ביום אשמתו׃ כה ואת אשמו יביא לה׳ איל תמים מן הצאן בערכך לאשם אל הכהן׃

Why is this מעל בה׳—betraying G-d? We might think that the מעילה, the crime against ה׳, was in swearing falsely, but the discussion of the same offering in ספר במדבר makes it clear that the crime itself is called מעילה בה׳:

ו דבר אל בני ישראל איש או אשה כי יעשו מכל חטאת האדם למעל מעל בה׳; ואשמה הנפש ההוא׃ ז והתודו את חטאתם אשר עשו והשיב את אשמו בראשו וחמישתו יסף עליו; ונתן לאשר אשם לו׃ ח ואם אין לאיש גאל להשיב האשם אליו האשם המושב לה׳ לכהן; מלבד איל הכפרים אשר יכפר בו עליו׃

למעל מעל בה׳: הרי חזר וכתב כאן פרשת גוזל ונשבע על שקר, היא האמורה בפרשת ויקרא ”ומעלה מעל בה׳ וכחש בעמיתו וגו׳“…

Violating דיני ממנות is a crime against G-d as well. It demonstrates a lack of faith:

אמר ר׳ עקיבא מה תלמוד לומר ומעלה מעל בה׳, לפי שכל המלוה והלוה והנושא והנותן אינו עושה אלא בעדים ובשטר, לפיכך בזמן שהוא מכחש מכחש בעדים ובשטר, אבל המפקיד אצל חבירו אינו רוצה שתדע בו נשמה אלא שלישי שביניהם, לפיכך כשהוא מכחש, מכחש בשלישי שביניהם.

And it is in fact a greater betrayal than taking from קודש, stealing from the בית המקדש, which is the classic crime of “מעילה”:

יד וידבר ה׳ אל משה לאמר׃ טו נפש כי תמעל מעל וחטאה בשגגה מקדשי ה׳; והביא את אשמו לה׳ איל תמים מן הצאן בערכך כסף שקלים בשקל הקדש לאשם׃ טז ואת אשר חטא מן הקדש ישלם ואת חמישתו יוסף עליו ונתן אתו לכהן; והכהן יכפר עליו באיל האשם ונסלח לו׃

ומעלה מעל בה׳:…וה״פ והלא בפרשת מעילות כתיב נפש כי תמעול מעל ולא כתיב ”בה׳“.

The Ohr HaChaim notes that three different crimes are described here: תחטא,‎ מעלה מעל בה׳ and כחש בעמיתו.

נפש כי תחטא ומעלה וגו׳: צריך לדעת למה אמר כי תחטא, ואין לנו לפרש כאן כי החטא הוא ההכחשה, שהרי הוא אומר וכחש בעמיתו. עוד אומרו מעל בה׳ מה שלא אמר בכל החטאות. עוד אומרו וכחש בעמיתו שלא היה צריך לומר בעמיתו. גם שיעור התיבה אינו מדוקדק.

ואולי כי יודיע הכתוב שלשה ענפי רשע שיעשה בעל עבירה זו. הא׳ נטילת דבר שאינו שלו, הוא ענף הגזל. ב׳ ”ומעלה מעל בה׳“, פירוש בה׳ כביכול עשה המעל…כי הוא שפט על פי המעשים וזיכה לזה שיהיה לו ממון, וכשזה בא וגוזלו נמצא שגורם מעילה בה׳…ונמצא ה׳ כביכול נחשד שלא עשה משפט צדק…ג׳ ”וכחש בעמיתו“…פירוש משים הכיחוש בעמיתו, שהוא הנגזל ממנו, משימו רשע.

There is the sin itself, of stealing, then there is the heresy of telling G-d, “you got this wrong. That property should be mine, not theirs”. And then there is the denial of עמיתו. That is an rare word (usually the Torah uses the word רֵעַ or אַח) that occurs only one other place, where it has a similar flavor:

ולא תונו איש את עמיתו ויראת מאלקיך; כי אני ה׳ אלקיכם׃

Taking someone else’s property denies their “עמיות”, denies that they are part of your society. And that connection between גזלה and society as a whole means that ומעלה מעל בה׳ is deeper than a complaint that I should have gotten more stuff. That is because דיני ממנות are unique in halacha. There is a concept called situmta:

אמר רב פפי משמיה דרבא: האי סיטומתא קניא…באתרא דנהיגו למקני ממש קנו.

סיטומתא: חותם שרושמין החנונים על החביות של יין שלוקחין הרבה ביחד ומניחין אותו באוצר הבעלים ומוליכין אותן אחת אחת למכור לחנות ורושמין אותם לדעת שכל הרשומות נמכרות.

ובאתרא כו׳ למיקני: שרגילין לרשום על מנת שבדבר זה תהא קנויה לו כאלו משך קני.

Even though the halacha is clear on what counts as a “קנין”, an acquisition, the common practice of a community overrides this.

ובדוכתא דקנו ממש קני: ושמעינן מינה, שהמנהג מבטל ההלכה וכל כיוצא בזה, שכל דבר שבממון על פי המנהג קונין ומקנין, הלכך בכל דבר שנהגו התגרים לקנות קונין.

על מחלוקת בין תובע לנתבע: א׳ אומר שרצונו להתדיין בד״ת; וא׳ אומר שאין לו להתדיין אלא בפני אחרים, שכך הוא המנהג במקום שנעשה העסק, הדין עמו. כיון דבמקום שנעשה העסק יש מנהג להתדיין כפי דרך הסוחרים ולא כפי ד״ת מנהג מבטל הלכה והביא ההיא דאסטימתא.

In interpersonal financial law, המנהג מבטל ההלכה. That is called סיטומתא (a generalization of the marked-wine-barrel case).

[M]inhag ha-sochrim is grounded in the halakhic principle of kol tenai she-be-mammon kayam (Jewish law confers upon parties the power to make their own provisions and stipulations to govern their private agreements). The theoretical basis for minhag hasochrim is that parties to an agreement can agree to explicitly contract in a wide array of provisions that would override the default rules of choshen mishpat. This power of the parties to explicitly make their own provisions is then extended to the realm of the implicit. Where there are prevailing commercial norms, the parties need not agree to these provisions explicitly because they have implicitly adopted them by doing business in a certain manner and context and under certain assumptions. By entering into an agreement under these background conditions, it is as if the parties had explicitly adopted those provisions.

Rav Shimon Shkop explains the legal philosophy underlying this principle:

ג שלא אסרה התורה את הגזל אלא מה שהוא של חבירו מצד הדין, אבל מה שהוא שלו מצד הדין לא אסרתו עליו התורה…

ד וביאור ענין זה הוא לענ״ד על פי הקדמה כללית דכל דיני המשפטים של דיני ממונות בין איש לרעהו, אינם כדרך כל מצוות התורה, דבכל המצוות הוא מה שהזהירה לנו תורה בעשה ול״ת, חיוב קיומם עלינו הוא העיקר לקיים מצות ה׳, ובדיני ממונות אינו כן, דקודם שחל עלינו מצות ה׳ לשלם או להשיב, צריך שיוקדם עלינו חיוב משפטי…ועוד כלל עיקרי בזה דהיכא שאנו דנים על איזה זכות וקנין של אדם באיזה חפץ או שעבוד ממון, אין אנו דנים כלל על ענין שמירת איזו מצוה, אלא ענין מציאות למי קנוי הדבר, ומי ומי ראוי על פי תורת המשפטים להחזיק את החפץ…הנה הלאו של איסור גזל הוא שלא יגזול איש מחבירו דבר שעל פי תורת המשפטים הוא של חבירו, וכן לא יעשוק שכר שכיר מה שעל פי משפט התורה הוא חייב לשלם…אם הממון הוא שלו, על פי משפט התורה איזה איסור גזל אפשר בזה?

Rav Shkop’s approach is that תורת המשפטים is not prescribed by the Torah, but is determined by society. The Torah forbids stealing, but tells human beings, “you decide what counts as property that can be stolen”. The laws of פרשת משפטים are a model, like the Uniform Commercial Code in the US.

The Uniform Commercial Code (UCC) is a standardized set of laws and regulations for transacting business. The UCC code was established in 1953 because it was becoming increasingly difficult for companies to transact business across state lines given the various state laws.

…The Uniform Commercial Code (UCC) was not established through Congress. It was created by private organizations…Each state has the option of adopting the code as it is written or adopting and modifying provisions of it.

Rav Shkop explains what private property is supposed to mean:

אם יאמר האדם להכניע את טבעו להגיע למדה יתירה עד שלא יהיה בנפשו שום מחשבה ושאיפה להיטיב לעצמו, וכל שאיפותיו יהיו רק להיטיב לאחרים, ובאופן כזה תהיה שאיפתו להגיע לקדושת הבורא…הורו לנו חז״ל במדרש זה שלא כן הוא שאין לנו להשתדל להדמות לקדושת הבורא יתברך בצד זה…

בדרך חיובי ראוי לאדם להקדים את טובת עצמו. ועוד יש מקום שביסוד בריאת אדם נטע הבורא יתברך בו תשוקת אהבת עצמו במדה גדולה מאד…

והנה אם בהשקפה ראשונה רגשי אהבת עצמו ורגשי אהבת זולתו הם כצרות זו לזו, אבל עלינו להשתדל להעמיק בזה למצוא הסגולה המאחדת אותם אחרי כי שניהם דורש ה׳ מאתנו…

האיש הגס והשפל, כל ”אני“ שלו מצומצם רק בחמרו וגופו. למעלה ממנו, מי שמרגיש ש”אני“ שלו הוא מורכב מגוף ונפש…ועוד יש בזה מעלות של איש השלם, ראוי להשריש בנפשו להרגיש שכל העולמות כולם הוא ה”אני“ שלו, והוא בעצמו רק כאבר קטן בתוך הבריאה כולה. ואז גם רגש אהבת עצמו עוזר לו לאהוב את כל עם ישראל ואת כל הבריאה כולה…

וכן ראוי להתבונן על כל מתנות שמים…התחלקותם להיחידים הוא רק בתור גזברות, על מנת שיחלקם לנצרכים, לכל אחד כחלק הראוי לו, וליטול לעצמו כפי חלקו הראוי לו.

The message is that ה׳ created us to want stuff. That isn’t morally wrong, but our responsibility is to realize that the stuff are tools, not the goal. ה׳ gives us those tools, and gives us the free will to decide how to use them to fulfill His will. There are certainly guidelines and some absolute rules (like ריבית), and we can certainly judge some civil rules to be unjust and work to change them, but underlying this all is an acknowledgement that I am a member of a society, and I need to work within the rules created by that society; my fellow human being is עמיתי. And the מעלה מעל בה׳ is not in the act of stealing per se but in the act telling G-d, “You messed up. You trusted us”.


That connects to what we talked about last week. The word מלאכה is polysemous; according to the Even Shoshan concordance, מלאכה appears 166 times in תנ״ך. Usually it means “work, activity”. In 8 cases, it means “property”. But those meanings are connected.

…מלאכה is simply the feminine of מלאך. What the מלאך is personally, מלאכה is factually. Just as a מלאך, a messenger, is the bearer and executor of the thought and intention of another, so מאלכה is a thing which has become the bearer and executor of the thought and intention of a mind…In a wider sense all the things which serve the purpose of an intelligent being are its מלאכה. So we find of Jacob’s property (בראשית לג:יד)‎ לרגל המלאכה אשר לפני. It is clear that only an intelligent being—G-d—and deep beneath Him, Man, can make a מאלכה.

The oath taken in our paragraph, for financial crimes, is all about מלאכה:

שבעת ה׳ תהיה בין שניהם אם לא שלח ידו במלאכת רעהו; ולקח בעליו ולא ישלם׃

Private property is meant to create responsibility. Just as ה׳ did not set up the rules of גמילות חסדים because we need to look at each other as subjects, not objects, so too did He not impose the rules of contracts because we need to work together to create a society in which private property—however determined—is respected. Society is a subject, not an object. גזלה is כחש בעמיתו, denying that the other is a member of the עם, and so denies ה׳'s model for the world and is מעלה מעל בה׳.
