This week's parsha recapitulates the laws of kashrut, and those end with: {:he} >לא תאכלו כל נבלה לגר אשר בשעריך תתננה ואכלה או מכר לנכרי כי עם קדוש אתה לה׳ אלקיך; לא תבשל גדי בחלב אמו׃ --דברים יד:כא What is a נבלה? Artscroll translates it as: >You shall not eat any carcass... --Artscroll Chumash, {:la}/loc. cit./ But that means "don't eat any dead animal". Since אבר מן החי is also forbidden, it sounds like G-d wants us to be vegetarians. But I'm not going to accept that. >If G-d did not intend for us to eat animals, then why did He make them out of meat? --[John Cleese](https://www.brainyquote.com/quotes/john_cleese_362725) So Artscroll explains what we already know, that נְבֵלָה means "a carcass, but not if it died according to the rules": >{:he}<span><em>נְבֵלָה</em></span>: *An animal that died*, i.e. a kosher species that died without /shechitah/. --Artscroll Chumash, Vayikra 7:24 But those rules are not specified in the Torah. They are part of the תורה שבעל פה, and we believe that those rules were given to Moshe at הר סיני along with the text of the תורה שבכתב. And we know that we are allows to eat meat, since this week's parsha explicitly says so: {:he} ><b>טו</b> רק בכל אות נפשך תזבח ואכלת בשר כברכת ה׳ אלקיך אשר נתן לך בכל שעריך; הטמא והטהור יאכלנו כצבי וכאיל׃ <b>טז</b> רק הדם לא תאכלו; על הארץ תשפכנו כמים׃ > ...<b>כ</b> כי ירחיב ה׳ אלקיך את גבלך כאשר דבר לך ואמרת אכלה בשר כי תאוה נפשך לאכל בשר בכל אות נפשך תאכל בשר׃ <b>כא</b> כי ירחק ממך המקום אשר יבחר ה׳ אלקיך לשום שמו שם וזבחת מבקרך ומצאנך אשר נתן ה׳ לך *כאשר צויתך* ואכלת בשעריך בכל אות נפשך׃ --דברים פרק יב It's worth noting that זבח means to "butcher", to kill an animal for its meat. שחט means specifically to slit the neck, and that isn't mentioned at all in our paragraph. {:he} >ויזבח יעקב זבח בהר ויקרא לאחיו לאכל לחם; ויאכלו לחם וילינו בהר׃ --בראשית לא:נד However, the text tells us וזבחת…כאשר צויתך, which implies that there are rules for זביחה: {:he} ><em>וזבחת…כאשר צויתך</em>: למדנו שיש צווי בזביחה היאך ישחט, והן הלכות שחיטה שנאמרו למשה בסיני. --רש״י, דברים יב:כא This is the one place where the תורה שבכתב tells us that it is incomplete (there is no other part of the Torah that has הלכות זביחה), that there must be another source of laws. In effect, the תורה שבכתב is incorporating the entire תורה שבעל פה by reference. >In law, incorporation by reference is the act of including a second document within another document by only mentioning the second document. This act, if properly done, makes the entire second document a part of the main document. Here's an example, from the recent St. Louis county mask mandate: >This Order is authorized pursuant to Executive Orders 10 through 18, which are incorporated herein by reference, and to Missouri and St. Louis County law, including the Missouri Constitution, §§ 192.006, 192.200, 192.260, 192.280, and 192.290 RSMo., Chapter 44 RSMo., 19 CSR 20-20.010, 20-20.040, and 20-20.050 of the Rules of the Department of Health and Senior Services, the St. Louis County Charter, and the St. Louis County Revised Ordinances. --[St. Louis County Department of Public Health 2019 Novel Coronavirus (“COVID-19”) Face Covering Order](https://stlcorona.com/dr-pages-messages/public-health-orders/all-public-health-orders-archives/face-covering-order/) I was curious how those who don't believe in תורה שבעל פה interpret כאשר צויתיך. >...how do Karaites explain "וזבחת....כאשר צויתיך"? > ...This refers to a few lines previously, in which we are commanded to spill the blood on the ground. --Conversation on [Mi Yodea](https://judaism.stackexchange.com/questions/45294/how-do-karaites-shecht) with "A Blue Thread", the pseudonym of a religious Karaite from Egypt. And Shadal, trying to read פשט, without interpreting in the light of the תורה שבעל פה, says something similar: {:he} ><em>כאשר צויתיך</em>: לדעתי מוסב לאסור הדם האמור למעלה. --שד"ל, דברים יב:כא In other words, at the פשט level, כאשר צויתיך *must* refer to other laws mentioned in the text of תורה שבכתב. It cannot refer to another body of law, since that is not part of the hermeneutic background of פשט. That's the question I want to focus on here: does the פשט here mandate the existence of extra-textual Divine laws? And as an aside, Karaites do have rules for slaughtering; actually they are *more* stringent than the halacha: >In the historical Karaite tradition, all four parts of the animal’s throat must be completely cut in order for the slaughter to be valid. > ...Karaites believe that the method of slaughter was known prior to the revelation at Sinai. As a result, the method has been passed down from generation to generation. There is something to be said for the fact that every historical Jewish community (at least of which I am aware) slaughters by slitting the neck. --A Blue Thread, [_Karaite Shechita: No Pregnant Animals Were Slaughtered For This Post_](http://abluethread.com/2013/12/02/karaite-shechita-pregnant-animals-slaughtered-post/) They just believe it is tradition rather than Divinely mandated, I think. I'm not a Karaite theologian. What's interesting is that Ramban (who clearly believed that ה׳ gave us the תורה שבעל פה, and that the laws of שחיטה are הלכות ממשה מסיני) also reads כאשר צויתיך to refer to other laws mentioned explicitly: {:he} >וטעם וזבחת וגו' כאשר צויתיך על דעת רבותינו (חולין כח) כאשר צויתיך על פה מהלכה למשה מסיני...ודע כי שחיטה בלשון הקדש הוא הכרת סימני הצואר...והנה צוה בקרבנות ושחט ושחטו שהוא בסימני הצואר. --רמב״ן, דברים יב:כא {:he} >ושחט את בן הבקר לפני ה׳; והקריבו בני אהרן הכהנים את הדם וזרקו את הדם על המזבח סביב אשר פתח אהל מועד׃ --ויקרא א:ה {:he} ><b>א</b> ואם זבח שלמים קרבנו אם מן הבקר הוא מקריב אם זכר אם נקבה תמים יקריבנו לפני ה׳׃ <b>ב</b> וסמך ידו על ראש קרבנו ושחטו פתח אהל מועד; וזרקו בני אהרן הכהנים את הדם על המזבח סביב׃ --ויקרא פרק ג So כאשר צויתיך means "slaughter your animals for [secular] food just as you have been commanded to slaughter the animals for sacrifices": {:he} >והנה מתחלה צוה שיהיה כל מה שהם אוכלים שלמים והם שחוטים כמשפט הקרבנות, ועתה כשבא להתיר בשר החולין אמר וזבחת מבקרך ומצאנך *כאשר צויתיך* בהיותם קרבנות ותאכל אותם חולין בכל תאות נפשך. לומר שיתירם חולין בכל מקום ובלבד שיהיו זבוחין כאשר צוה מתחלה בהיותם כולם קרבנות *וזהו פשוטו של מקרא זה על הנכון* ושמא רבותינו נתכונו בזה כשאמרו בספרי (ראה לט) כאשר צויתיך מה קדשים בשחיטה אף חולין בשחיטה. והנה מצות השחיטה מפורשת בכאן ומבוארת מדברי רבותינו בקבלה. --רמב״ן, דברים יב:כא Similarly, the Netziv: {:he} ><em>כאשר צויתיך</em>: עד כה דיני שחיטה בקדשים כן תעשה גם בחולין. --העמק דבר, דברים יב:כא So they are taking two steps: כאשר צויתיך refers to the previous rules about שחיטה, which come from the תורה שבעל פה, but they are saying that the laws are explictly *not* being included by reference. The existence of תורה שבעל פה is implied, but is never explicitly mentioned in the תורה שבכתב. I think the reason for this relates to a דרש of the Bais HaLevi. If כאשר צויתך refers to the תורה שבעל פה, then that תורה שבעל פה is "discoverable" in the legal sense. >If there is ever an incident, per Risk Management, it should never be documented in the note that an incident report was filed. Incident reports and their follow up need to remain internal and confidential. --My boss If כאשר צויתך refers to something outside the Torah, then reading the Torah would require reading this other text, the תורה שבעל פה. And we don't want to imply that there is "another text". תורה שבעל פה is not a text, it is a מסורה. The Bais HaLevi starts with the midrash: {:he} >וַיֹּאמֶר ה' אֶל מֹשֶׁה כְּתָב לְךָ אֶת הַדְּבָרִים הָאֵלֶּה כִּי עַל פִּי הַדְּבָרִים הָאֵלֶּה כָּרַתִּי אִתְּךָ בְּרִית וְאֶת יִשְׂרָאֵל׃ --שמות לד:כז {:he} > <em>כתב לך את הדברים האלה</em>: הדא הוא דכתיב (הושע ח:יב): אֶכְתָּב לוֹ רֻבֵּי תּוֹרָתִי כְּמוֹ זָר נֶחְשָׁבוּ. בשעה שנגלה הקדוש ברוך הוא בסיני לתן תורה לישראל, אמרה למשה על הסדר מקרא ומשנה תלמוד ואגדה, שנאמר (שמות כ:א): וַיְדַבֵּר אֱלֹקִים אֵת כׇּל הַדְּבָרִים הָאֵלֶּה, אפלו מה שהתלמיד שואל לרב אמר הקדוש ברוך הוא למשה באותה שעה. מאחר שלמדה מפי הקדוש ברוך הוא, אמר לו למדה לישראל. אמר לפניו: רבונו של עולם, אכתב אותה להם! אמר לו: איני מבקש לתנה להם בכתב, מפני שגלוי לפני שעובדי כוכבים עתידים לשלט בהם ולטל אותה מהם ויהיו בזויים בעובדי כוכבים, אלא המקרא אני נותן להם במכתב, והמשנה והתלמוד והאגדה אני נותן להם על פה, שאם יבואו עובדי כוכבים וישתעבדו בהם יהיו מבדלים מהם. אמר לנביא *אם* אֶכְתָּב לוֹ רֻבֵּי תּוֹרָתִי כְּמוֹ זָר נֶחְשָׁבוּ, ומה אני עושה להם, נותן את המקרא בכתב, והמשנה והתלמוד והאגדה בעל פה. כְּתָב זה המקרא; כִּי עַל פִּי הַדְּבָרִים הָאֵלֶּה זו המשנה והתלמוד, שהם מבדילים בין ישראל לבין העובדי כוכבים. --שמות רבה מז:א תורה שבעל פה represents our relationship with הקב״ה. {:he} >ולמדנו ממנו דמשה לא ניתן הכל בכתב משום שאוה״ע היו נוטלין אותו ג״כ וכמו שראינו אח״כ בימי תלמי שהעתיקו להם התורה שבכתב ולא היה ישראל מובדלין מהם ומש״ה נתן בע״פ שלא יקבלו אותו מהם וישארו ישראל מובדלים מהם, וכמו שאנחנו רואה עתה בחוש דעיקר המבדיל בין ישראל לאוה״ע הוא רק הך תורה שבע״פ. --בית הלוי, דרוש יח {:he} >וא"ר יוחנן לא כרת הקב"ה ברית עם ישראל אלא בשביל דברים שבעל פה שנאמר כי על פי הדברים האלה כרתי אתך ברית ואת ישראל. --גיטין ס,ב I think that the issue is not so much that we don't want the goyim to have this special treasure, but that they would treat it as yet another book. And that applies to us as well. Even though the Talmud has been written down, it can't be "read". It has to be "learned". Then the Bais HaLevi brings the aggadah that the first לוחות included, in some mystical way, *everything*: all the תורה שבעל פה and all the תורה שבעל פה. There would have been no מסורה בעל פה. {:he} >(שמות לב:טו) [לֻחֹת כְּתֻבִים מִשְּׁנֵי עֶבְרֵיהֶם] מִזֶּה וּמִזֶּה הֵם כְּתֻבִים...חנניה בן אחי רבי יהושע אומר: בין כל דיבור ודיבור דקדוקיה ואותיותיה של תורה. --ירושלמי שקלים כה,א, ו:א But with the לוחות שניות, our relationship to the Torah changed: {:he} >והנה עי״ז שניתן להם אח״כ בעל פה נתעלו בה ישראל מעלה גדולה יותר, דמקודם דכל התורה היה רמוז בהלוחות, היו ישראל והתורה שני עייינים, דישראל הם המקיימים להתורה ושומרים אותה והיו אז כבחינת כלי שמונח בו התורה וכמו אה״ק שמונח בו הס״ת והוא תשמישי קדושה. אבל אח״כ דניתן להם התורה שבע״פ נמצא דישראל הם בבחינת קלף של תושבע״פ וכמאה״כ (משלי ז:ג) כָּתְבֵם עַל לוּחַ לִבֶּךָ. וכמו שהקלף של ס״ת הוא עצם הקדושה ולא תשמיש, דהקלף והכתב שכתוב בו שניהם ביחד הם ס״ת, כמו כן התורה וישראל כולא חד הוא. --בית הלוי, דרוש יח תורה שבכתב can be treated like a book. But the existence of תורה שבעל פה means that Torah only *exists* in the minds of כנסת ישראל.‎ כאשר צויתך cannot mean that there's another book laying around that we can casually read. תורה שבעל פה must be internalized. {:he} >וכבר אמרו בגמרא: לא כרת הקב"ה ברית עם ישראל אלא בשביל תורה שבע"פ, שנאמר: ”כי ע״פ הדברים האלה כרתי אתך ואת ישראל“ והוא כריתת ברית והאהבה הנפלאה שנתן לנו תורה שבע"פ במתנה גמורה. ”וממדבר מתנה“ כפי הכרעת החכמים. ואמרו בש״ס: תורה רובה בע״פ ומיעוט בכתב, שנאמר: ”אכתוב להם רובי תורתי כמו זר נחשבו“. והיינו, דאם היה הכל בכתב מיד ה׳ עלינו השכיל, אנחנו כמו זר נחשבו. כי מה לשכל האנושי להבין בתורת ה׳? אבל בתורה שבע"פ משלנו הוא. --קצות החושן הקדמה And so we become in effect the קלף on which the תורה שבעל פה is written. And we can enjoy a good steak.
