This is a re-presentation of <//פרשת נצבים תשע״ו> and was inspired by Gil Student's article in the 2012 Orthodox Forum, <a href="http://www.yutorah.org/lectures/lecture.cfm/777842/Rabbi_Gil_Student/The_Decline_and_Fall_of_Local_Rabbinic_Authority ">"The Decline and Fall of Local Rabbinic Authority"</a> (<a href="http://download.yutorah.org/2012/1053/777842.pdf">available as a PDF</a>) and is largely based on Aaron Kirschenbaum's article in Tradition, <a href="http://traditionarchive.org/news/originals/Volume%2027/No.%204/MaraDe-Atra.pdf"> “<i lang=he>Mara D’Atra</i>: A Brief Sketch”</a> and Jonathan Ziring's lecture on YU Torah, <a href="http://www.yutorah.org/lectures/lecture.cfm/820626/rabbi-jonathan-ziring/the-authority-of-a-mara-d-atara-in-a-globalized-world-the-role-of-baal-habatim-in-psak-3-/">“The Authority of a <i lang=he>Mara D’Atra</i> in a Globalized World”</a>. There's a famous paragraph in this week's parasha: <blockquote lang=he><p><b>יא</b> כי המצוה הזאת אשר אנכי מצוך היום לא נפלאת הוא ממך ולא רחקה הוא׃ <b>יב</b> לא בשמים הוא; לאמר מי יעלה לנו השמימה ויקחה לנו וישמענו אתה ונעשנה׃ <b>יג</b> ולא מעבר לים הוא; לאמר מי יעבר לנו אל עבר הים ויקחה לנו וישמענו אתה ונעשנה׃ <b>יד</b> כי קרוב אליך הדבר מאד; בפיך ובלבבך לעשתו׃</p> <footer class=source>דברים פרק ל</footer></blockquote> But המצוה הזאת is ambiguous; there are two possible interpretations based on the previous paragraph: <blockquote lang=he><p>ואתה תשוב ושמעת בקול ה׳; ועשית את כל מצותיו אשר אנכי מצוך היום׃</p> <footer class=source>דברים פרק ל:ח</footer></blockquote> <hr/> One possibility is that המצוה הזאת is the mitzvah of teshuva: <blockquote lang=he><p> ”המצוה הזאת“ על התשובה הנזכרת, כי והשבות אל לבבך (בפסוק א) ושבת עד ה׳ אלקיך (בפסוק ב) מצוה שיצוה אותנו לעשות כן. </p> <footer class=source>רמב״ן, דברים ל:יא</footer></blockquote> But many commentators understand המצוה הזאת to be a collective noun for שמעת בקול ה׳ ועשית את כל מצותיו: <blockquote lang=he><p><em>כי המצוה הזאת</em>: יאמר זה על התורה.</p> <footer class=source>רבינו בחיי, דברים ל:יא </footer></blockquote> And the paragraph is a reassurance that the Torah, despite being the word of G-d, is achievable: <blockquote lang=he><p> <em>לא נפלאת היא ממך</em>: שתצטרך לנביאים. <em>ולא רחוקה היא</em>: שתצטרך לחכמי הדור הרחוקים שיפרשו לך באופן שתוכל לעשותה אפילו בעודך בגלות. </p> <footer class=source>ספורנו, דברים ל:יא</footer></blockquote> So our text is telling us that we don't <em>have</em> to go to heaven or across the sea to learn Torah. That's פשט. But let's look deeper. <hr/> At the דרש level, the text warns us how *not* to learn Torah: <blockquote lang=he><p>רבא אמר: לא בשמים היא--לא תמצא במי שמגביה דעתו עליה כשמים, ולא תמצא במי שמרחיב דעתו עליה כים. </p> <footer class=source>עירובין נה,א </footer></blockquote> <blockquote lang=he><p> היינו שדעתו גבוה ואין צריך לקבל מרב ולא תמצא במי שמרחיב דעתו כו' גם אם הוא מקבל מרב לא ירחיב דעתו לסמוך על זה דדי לו בקבלתו אלא דצריך לחזור אחריה שלא תשתכח ממנו. </p> <footer class=source>מהרש״א חידושי אגדות, שם</footer></blockquote> The Rambam mentions another interpretation of לא מעבר לים היא: {:he} >...וְלֹא כָל הַמַּרְבֶּה בִסְחוֹרָה מַחְכִּים... --משנה אבות ב:ה {:he} >ואמרו שהתורה לא תמצא בבעלי הגאוה והגסות ולא בהולכי ארצות רחוקות, וסמכו זה לפסוק *על צד המליצה* ואמרו לא בשמים היא לאמר וגו' ולא מעבר לים היא וגו' אמרו לא בגסי הרוח היא, ולא במהלכי מעבר לים היא. --רמב״ם, פירוש המשניות, שם <hr/> But even at the פשט level, there are consequences to לא בשמים היא. We all know the famous interpretation: not so much that we do not <em>have</em> to go to heaven to learn what ה׳ wants from us, but that we <em>may</em> not. לא בשמים היא means Torah is not in Heaven; don't bother looking there, as Sforno says, לנביאים. <blockquote lang="he"><p>אמר רב יהודה אמר שמואל שלשת אלפים הלכות נשתכחו בימי אבלו של משה אמרו לו ליהושע שאל א״ל (דברים ל) <em>לא בשמים היא</em>.</p> <footer class="source">תמורה טז,א</footer></blockquote> <blockquote lang=he><p>חזר ואמר להם אם הלכה כמותי מן השמים יוכיחו! יצאתה בת קול ואמרה מה לכם אצל ר״א שהלכה כמותו בכ״מ? עמד רבי יהושע על רגליו ואמר לא בשמים היא! מאי (דברים ל) לא בשמים היא? אמר רבי ירמיה שכבר נתנה תורה מהר סיני אין אנו משגיחין בבת קול שכבר כתבת בהר סיני בתורה (שמות כג) אחרי רבים להטות. אשכחיה רבי נתן לאליהו; א״ל מאי עביד קוב״ה בההיא שעתא א״ל קא חייך ואמר נצחוני בני, נצחוני בני. </p> <footer class=source>בבא מציעא נט,ב</footer></blockquote> That's understanding לא בשמים הוא. How do we understand לא מעבר לים הוא? I haven't seen an answer for this, but I would like some parallel interpretation to לא בשמים הוא. If לא מעבר לים הוא means it is not the case that שתצטרך לחכמי הדור, then does the parallel mean I cannot ask חכמי הדור who are מעבר לים? Perhaps. I often point out that I will not try to give הלכה למעשה; you should consult your LOR, your local Orthodox rabbi. I won't deal now with what "Orthodox" means (motivation and mindset) or "rabbi" (qualifications and certification). But what do we mean by "local"? There's a concept of מרא דאתרא: <blockquote lang=he><p>אמר אביי שמע מינה צורבא מרבנן דאיכא במתא כל מילי דמתא עליה רמיא.</p> <footer class=source>מועד קטן ו,א</footer></blockquote> And it has halachic ramifications. The local rabbinic authority determines halacha, even if others disagree: <blockquote lang=he><p> ר׳ עקיבא סבר: חיה ועוף אינן מן התורה; הא מדרבנן אסירי, ור׳ יוסי הגלילי סבר: עוף אפילו מדרבנן נמי לא אסיר...במקומו של רבי יוסי הגלילי היו אוכלין בשר עוף בחלב. לוי איקלע לבי יוסף רישבא, אייתו לקמיה רישא דטיוסא בחלבא, ולא אמר להו ולא מידי, כי אתא לקמיה דרבי, אמר ליה: אמאי לא תשמתינהו? אמר ליה: אתריה דרבי יהודה בן בתירא הוא, ואמינא, דרש להו כרבי יוסי הגלילי דאמר יצא עוף שאין לו חלב אם. </p> <footer class=source>חולין קטז,א</footer></blockquote> <blockquote lang=he><p>דרב ושמואל הוו יתבי בההוא חצר, נפל גודא דביני ביני. אמר להו שמואל: שקולו גלימא נגידו בה. אהדרינהו רב לאפיה...ורב, אי סבירא ליה דאסירת לימא ליה! אתריה דשמואל הוה. אי הכי, מאי טעמא אהדרינהו לאפיה? דלא נימרו כשמואל סבירא ליה, והדר ביה משמעתיה. </p> <footer class=source>עירובין צד,א</footer></blockquote> <hr/> Now this seems to contradict the rules in previous parshiot about the centralization of halachic decision-making, but those rules only apply when the local authority is unsure: <blockquote lang=he><p><b>ח</b> <em>כי יפלא ממך דבר</em> למשפט בין דם לדם בין דין לדין ובין נגע לנגע דברי ריבת בשעריך; וקמת ועלית אל המקום אשר יבחר ה׳ אלקיך בו׃ <b>ט</b> ובאת אל הכהנים הלוים ואל השפט אשר יהיה בימים ההם; ודרשת והגידו לך את דבר המשפט</p> <footer class=source>דברים פרק יז</footer></blockquote> <blockquote lang=he><p><b>ז</b> כשהיה בית דין הגדול קיים לא הייתה שם מחלוקת בישראל; אלא כל דין שנולד בו ספק לאחד מישראל שואל לבית דין שבעירו. אם ידעו אמרו לו; ואם לאו הרי השואל עם אותו בית דין או עם שלוחו עולין לירושלים ושואלין לבית דין שבהר הבית. אם ידעו אמרו להם; ואם לאו הכול באין לבית דין שעל פתח העזרה. אם ידעו אמרו להם; ואם לאו הכול באים ללשכת הגזית לבית דין הגדול ושואלין.</p> <p><b>ח</b> אם היה הדבר שנולד בו הספק לכול ידוע אצל בית דין הגדול בין מפי הקבלה בין מן המידה שדנו בה אומרין להם מיד; ואם לא היה הדבר ברור אצל בית דין הגדול דנין בו בשעתן ונושאין ונותנין בדבר עד שיסכימו כולן או יעמדו למניין וילכו אחר הרוב ויאמרו לכל השואלין כך הלכה וילכו להם.</p> <footer class=source>משנה תורה, הלכות ממרים פרק א</footer></blockquote> But why the מרא דאתרא? Why should a <em>local</em> Orthodox rabbi have halachic priority? My answer is that it is implied in לא מעבר לים הוא; just like we may not look to heaven to interpret the Torah, so too we <em>may not</em> look to anyone but our local authority to interpret the Torah. That seems obvious to me but I haven't found anyone who cites it. Maybe it's just my חידוש in Torah. The מגן אברהם‎ (יורה דאה רמב:כב) derives this rule from the principle of הסגת גבול, but that would seem to only apply if he is being paid. The רשב״א in an important תשובה points out that even if a community follows a certain (past or distant) פוסק, the people still owe allegiance to the local רב: <blockquote lang=he><p>אבל <em>אם היה רב אחד במקומם ולמדם הן הולכים אחר דבריו</em>. זהו חלוקת ארץ ישראל ובבל בתרבא דאיתרא דאלו אוסרין ואלו מתירין ואוכלין. ואוכל בחשאי אפי׳ בבבל אם דעתו לחזור ולהמנות עם אנשי מקומו ואף על פי שהוא חלב דאורייתא לדברי בני בבל...ומן הדרך הזה כל שנהגו לעשות כל מעשיהם על פי אחד מגדולי הפוסקים במקום שנהגו לעשות כל מעשיהם על פי הלכות הרב אלפסי זכרונו לברכה ובמקומות שנהגו לעשות כל מעשיהם על פי חבור הרמב״ם ז״ל והרי עשו אלו הגדולים כרבם. ומיהו אם יש שם אחד חכם וראוי להוראה ורואה ראיה לאסור מה שהם מתירין נוהג בו איסור. שאין אלו כרבם ממש דבמקום רבם אילו יעשו שלא כדבריו <em>יקלו בכבוד רבם</em> במקומו.</p> <footer class=source>שו״ת הרשב״א חלק א סימן רנג</footer></blockquote> [Note that he gives the reason for listening to the מרא דאתרא as כבוד הרב] And the local rabbi still has authority, even when he disagrees with the גדול הדור: <blockquote lang=he><p>בדבר שיש לך איזה חשש לקבוע מקומך בבני ברק מצד שבתוך דברי תורה איכא פעמים שאתה אומר שלא כדברי החזון איש זצ״ל...ליכא שום חשש ושום קפידא להשאר בבני ברק ולומר שיעורים ואדרבה יהיה מליץ יושר בעדך על שאתה מעיין בספריו. </p> <footer class=source>שו״ת אגרות משה יורה דעה חלק ג סימן פח </footer></blockquote> <blockquote lang=he><p>כי אין מהראוי להשיב על שאלה הלכה למעשה לתלמיד יחידי במקום שיש לו רב.</p> <footer class=source>שו״ת חתם סופר חלק א (אורח חיים) סימן ב </footer></blockquote> <blockquote lang=he><p> אמנם לא ידעתי אם יש רב יושב על כסא הוראה דקהלתכם כי אז אליו תשמעון ודברי כלא היו, אך במקום שאין איש כי אם פר״מ [I don't know what that stands for] רוצה לשמוע מה דעתי בענין זה... </p> <footer class=source>שו״ת חתם סופר חלק א (אורח חיים) סימן קכג</footer></blockquote> <hr/> But why should a local rabbi have more authority? What's the connection between geography and halacha (especially in a technology-centered society like ours; why does אתרא matter)? Rabbi Ziring points out that there are some things that have to be done in person: <blockquote lang=en><p>[A]rguments were offered by Rav Sar Shalom Geon (9th century) for why the Geonim preferred not to write commentaries on the Gemara (which would have made them publicly accessible) and instead preferred that people direct their questions to them. He notes that in person, it is easier to clarify, be th[o]rough, make sure there are no misunderstandings, etc.</p> <footer class=source><a href="https://shaashuim.wordpress.com/2014/11/22/the-benefits-of-asking-a-shayla-in-person-from-the-geonim/">Jonathan Ziring, <cite>The Benefits of Asking a Shayla in Person--From the Geonim</cite></a></footer></blockquote> <blockquote lang=he><p>שר שלום...גוי שהכניס ידו בתוך יינו של ישראל...</p> <p> ואם היה רצון והייתם לפנינו היה אפשר לפרשן יפה יפה ולבררן יפה יפה זו מזו כמות דבר דבור על אפניו, מפני שכשתלמיד יושב בפני רבו וישא ויתן בדבר הלכה, יודע רבו לאיזה צד לבו נוטה ומה מתעלם ממנו ומה מתברר לו ומה מתעקש עליו ופושט לו, עד שמאיר עיניו ומראה לו פנים בהלכה. אבל בכתב כמה אפשר לו אלא מקצת צוינו וכתבו לכם כללות של יין נסך.</p> <footer class=source>תשובות הגאונים, גאונים קדמונים סימן מו</footer></blockquote> And he quotes Rav Henkin (the American posek, the grandfather of the murdered Eitam Henkin) about the dangers of psak by telephone: <blockquote lang=he><p>ולא יפה עושים הפונים בשאלות ע״י טיליפון...כי כששאולים את הרב פנים בפנים אז יש לו זמן לעיין בספר ולהמלך. ואם מזדמן שהרב חוזר בו מהוראתו יכול לתקן...מה שאין כן ע״י טיליפון, והרי עלול לטעות. ועל כן יש רבנים שאין משיבים על שאלות שע״י טיליפון. ועכ״פ השואל בודאי לא טוב עושה, שאינו הולך לשאול פנים בפנים...</p> <footer class=source>הרב יוסף אליהו הינקין, עזרת ישראל ע׳, cited in <a href="http://www.yutorah.org/download.cfm?materialID=518731">Rabbi Jonathan Ziring, <cite>The Authority of a Mara D'Atara in a Globalized World</cite></a></footer></blockquote> We can't rely on rabbis that are מעבר לים for sensitive and personal halachic decisions, since they do not know us or our situations. A שאלה has to be asked פנים בפנים in order to get a meaningful answer. As Rabbi Student says, bemoaning the loss of local authority: <blockquote lang=en><p>Roshei yeshivah need to send their students to local rabbis as appropriate. Of course, I am not suggesting that the yeshivah is not a place for teaching practical halakhah by answering questions. However, there are questions, and there are questions. When a student wants to know whether his torn zizit have been invalidated, that is certainly an appropriate question for a rosh yeshivah. But when he wants to know whether he should attend his cousin’s intermarriage, it is entirely appropriate for a rosh yeshivah to send a student to his local rabbi (and maybe even call the rabbi directly as well). </p> <footer class=source><a href="http://download.yutorah.org/2012/1053/777842.pdf">Rabbi Gil Student, <cite>The Decline and Fall of Local Rabbinic Authority</cite></a></footer></blockquote> Just like לא בשמים הוא,‎ה׳ has given the Torah for us to understand as human beings; לא מעבר לים הוא,‎ ה׳ has given the Torah as it applies to each of us, to be understood by those who know us as individual human beings.
