We are continuing to work our way through משלי פרק יד. {:he} >עד אמונים לא יכזב; ויפיח כזבים עד שקר׃ --משלי יד:ה It is forbidden to be an עד שקר; it's one of the big ten: {:he} >לא תרצח <br/> לא תנאף; <br/> לא תגנב <br/> לא תענה ברעך עד שקר׃ --שמות כ:יג But this statement says something more: an עד שקר is a one-time sin; a יפיח כזבים is a character trait. Shlomo is telling us that being deceptive becomes a vicious cycle that is hard to get out of. Getting into the habit of כָּזָב will lead to the capital crime of being an עד שקר even if you don't intend for things to go that far. {: .lines} >O, what a tangled web we weave, When first we practise to deceive! -- Sir Walter Scott, _Marmion_, Canto 6, stanza 17 And the problem is כזב, deception, not שקר, falsehood. The falsehood is subtle and intentional. Simply telling a falsehood doesn't make you a כוזב; in Alex Ozar's felicitous phrase, lying doesn't make you a liar. >A prospective witness meeting all the standard criteria for eligibility (e.g. an adult Jewish male), for instance, may be disqualified from testimony on account of his prior conduct, and this in various ways. Most powerfully, those known to have committed certain grave sins, such as Sabbath violation or murder, are unanimously ruled resha’im and thus ineligible out of hand. For lesser crimes there are several disputes, with the various rulings depending on the severity and form of the prior violation relative to the judicial proceedings at hand (see Sanhedrin 27a). > Importantly, credibility is not all or nothing: Someone convicted of financial crimes and thus ineligible for testimony in financial litigation may remain eligible for testimony in capital cases on account of the greater solemnity assumed for the latter; just because someone is willing to lie for nickels and dimes doesn’t mean they’ll lie when the stakes are life and death. Similarly, according to R. Nahman (as interpreted by Rava), someone suspected of sexual impropriety remains eligible for testimony in general but is disqualified for cases concerning a woman’s marital status, particularly when the testimony, if accepted, would result in the woman’s newfound marital availability. We have often cited the midrash that says that human beings cannot tell the Truth; כלו שקרים. {:he} >אמר רבי סימון: בשעה שבא הקדוש ברוך הוא לבראת את אדם הראשון, נעשו מלאכי השרת כתים כתים, וחבורות חבורות. מהם אומרים אל יברא, ומהם אומרים יברא. הדא הוא דכתיב (תהילים פה:יא): חֶסֶד וֶאֱמֶת נִפְגָּשׁוּ צֶדֶק וְשָׁלוֹם נָשָׁקוּ. חסד אומר יברא, שהוא גומל חסדים. ואמת אומר אל יברא, שכלו שקרים. צדק אומר יברא, שהוא עושה צדקות. שלום אומר אל יברא, דכוליה קטטה. מה עשה הקדוש ברוך הוא? נטל אמת והשליכו לארץ... --בראשית רבה ח:ה But saying a שקר does not disqualify a person from being a witness. >Bridging the intentional/unintentional thievery issue with our more direct concern of lying is a fascinating ruling in Bava Metzia 5a. Suppose I confront you with a demand to return the watch I’d lent you and you deny having it. If the watch is found to have been on your person at the time of your denial, your lie renders you invalid as a witness going forward, as the lie was a clear act of intentional thievery. If, however, I had lent you money--where the presumption is that you were welcome to spend it in the interim--or if you simply didn’t have the watch on hand, your denial is non-incriminating. Why? Because, the gemara says, it may be that rather than intending to do away with my money, you were merely “pushing me off,” buying time to gather the funds. Perhaps, though you fully intended to repay the debt in good time, you were worried that if you conceded the debt, your failure to pay on the spot would be damaging in some way (Rashi ad loc.). David in ספר תהילים said everyone is a כזב: {:he .lines} >אך הבל בני אדם כזב בני איש; במאזנים לעלות; המה מהבל יחד׃ --תהילים סב:י But he realizes that was a rash statement. It simply isn't the case. {:he} >אני אמרתי בחפזי; כל האדם כזב׃ --תהלים קטז:יא When he was not בחפז, with time to think, it was clear that not כל האדם כזב even though כלו שקרים. That is Shlomo's point. It is יפיח כזבים, breathing and living intentional deception, that results in an עד שקר. Work on being an עד אמונים, a faithful witness, to the best of your ability, even if it's impossible to be a real עד אמת. ---- {:he} >בקש לץ חכמה ואין; ודעת לנבון נקל׃ --משלי יד:ו We talked about the לץ, the cynic, in <//Voice of Reason>. We pointed out that Jews love sarcasm. It goes way back: {:he} >ויאמרו אל משה המבלי אין קברים במצרים לקחתנו למות במדבר; מה זאת עשית לנו להוציאנו ממצרים׃ --שמות יד:יא And I'm as guilty as anyone. I'd like to think my sarcasm is self-deprecating humor and I'm not putting anyone else down, but my kids will give me מוסר when I've gone too far. Sarcasm is so ingrained into Jewish culture that it's impossible to root it out; even our greatest נביאים get sarcastic: {:he} >ויהי בצהרים ויהתל בהם אליהו ויאמר קראו בקול גדול כי אלהים הוא כי שיח וכי שיג לו וכי דרך לו; אולי ישן הוא ויקץ׃ --מלכים א יח:כז The reason that it is so pernicious is that it's not always bad: {:he} >אמר רב נחמן: כל ליצנותא אסירא חוץ מליצנותא דעבודת כוכבים דשריא, דכתיב (ישעיהו מו:א-ב) כָּרַע בֵּל קֹרֵס נְבוֹ...קָרְסוּ כָרְעוּ יַחְדָּו לֹא יָכְלוּ מַלֵּט מַשָּׂא. --סנהדרין סג,ב >We can lock /lashon hara/ away in the forbidden zone, because we are *never* allowed to speak /lashon hara/. We can lock dishonesty away in a forbidden zone, because we are never allowed to lie. We can lock sycophantic flattery away in a forbidden zone, because it is always forbidden. But we cannot do the same for cynicism. We cannot say, "Never be a cynic". It is simply not true. From time to time, you have to be a cynic. If we don't think anything is important, then we won't try to learn anything; what's the point? So the לץ will never find wisdom, even if it's obvious: דעת לנבון נקל. Keep your sarcasm under control. ---- The next pasuk is about neighbors: {:he} >לך מנגד לאיש כסיל; ובל ידעת שפתי דעת׃ --משלי יד:ז We've seen this idea before: {:he} >הולך את חכמים יחכם; וְרֹעֶה כסילים ירוע׃ --משלי יג:כ Here Shlomo teaches that the damage done by hanging out with the כסיל, is that בל ידעת שפתי דעת, you lose your own wisdom. That happens from the nature of the כסיל. We've translated that as the one who is self-assured, who doesn't need to learn from anyone else. The כסיל is the master of truthiness. >Truthiness is the belief or assertion that a particular statement is true based on the intuition or perceptions of some individual or individuals, without regard to evidence, logic, intellectual examination, or facts. It is a fake word invented by a fake person, Stephen Colbert, the comedian whose character, Stephen Colbert, parodies cable news talk shows on his own cable show, "The Colbert Report."... > Webster's has now sanctioned truthiness with two definitions: "truth that comes from the gut, not books" and "the quality of preferring concepts or facts one wishes to be true, rather than concepts of facts known to be true." At the end of his truthiness skit, Colbert says, "I know some of you may not trust your gut, yet. But, with my help, you will. The truthiness is, anyone can read the news to you. Think of this as "A king had seven subjects put in a room, and told six of them to give the wrong answer..." But it still tells us a truth about human nature. > Morals, religions, politics, get their following from surrounding influences and atmospheres, almost entirely; not from study, not from thinking. A man must and will have his own approval first of all, in each and every moment and circumstance of his life--even if he must repent of a self-approved act the moment after its commission, in order to get his self-approval again: but, speaking in general terms, a man's self-approval in the large concerns of life has its source in the approval of the peoples about him, and not in a searching personal examination of the matter. --Mark Twain, [_Corn-pone Opinions_](https://www.paulgraham.com/cornpone.html) So be careful of who you listen to. לך מנגד לאיש כסיל. ---- Shlomo extends the thought: {:he} >חכמת ערום הבין דרכו; ואולת כסילים מרמה׃ --משלי יד:ח ואולת כסילים מרמה uses a lot of terms for foolishness, but there are subtle distinctions. The אויל may know the right thing to do, but does wrong anyway. The כסיל thinks they know everything and won't learn. Sometimes they may be right. Even a stopped clock is right twice every day (though that metaphor no longer makes any sense). But it doesn't matter, because that correctness is אולת כסילים: it won't lead to correct action, because the כסיל treats everything as מרמה. We talked about that in <//Horsefeathers>: מרמה is not so much the intent to lie (that's כוזב) but the casual disregard for the truth. חכמה, phronesis, is the knowledge of right and wrong that leads to the right action. The lack of awareness of ones speech corresponds to the lack of awareness of ones actions. {:he} >וְעִנְיָנוֹ שֶׁל הַזְּרִיזוּת מְבֹאָר, שֶׁהוּא הַהַקְדָּמָה לַמִּצְוֹת וּלְהַשְׁלָמַת עִנְיָנָם. וְכַלָּשׁוֹן הַזֶּה אָמְרוּ זִכְרוֹנָם לִבְרָכָה (פסחים ד,א): זְרִיזִים מַקְדִּימִים לַמִּצְוֹת. > וְזֶה, כִּי כְּמוֹ שֶׁצָּרִיךְ פִּקְּחוּת גָּדוֹל וְהַשְׁקָפָה רַבָּה לִנָּצֵל מִמּוֹקְשֵׁי הַיֵּצֶר וּלְהִמָּלֵט מִן הָרַע שֶׁלֹּא יִשְׁלֹט בָּנוּ לְהִתְעָרֵב בְּמַעֲשֵׂינוּ כֵּן צָרִיךְ פִּקְּחוּת גָּדוֹל וְהַשְׁקָפָה לֶאֱחֹז בַּמִּצְוֹת וְלִזְכּוֹת בָּהֶם וְלֹא תֹּאבַדְנָה מִמֶּנּוּ. --מסילת ישרים ו׳ ---- And we come back to the cynic. {:he} >אולים יליץ אשם; ובין ישרים רצון׃ --משלי יד:ט Rashi translates יליץ as "is a spokesman". {:he} ><em>אוילים יליץ אשם</em>: שהם חוטאים, שצריכין לתת ממון למי שחטאו לו, ויליץ בעדם אשמם, שהם מביאים ממונם לו. --רש״י, משלי יד:ט We use that meaning on Rosh Hashana: {:he} >באין מליץ יושר מול מגיד פשע --תפילת מוסף ראש השנה, נוסח אשקנז But other מפרשים connect the word to לץ above: the אויל is cynical about bringing an אשם and therefore doesn't do any real תשובה, while the ישר gets רצון ה׳ and ends up with מחילה for what they have done wrong. {:he} ><em>אוילים יליץ אשם</em>:...המליץ בינותם כלומר יליץ לעשות אשם...כשיעשה אשם יתלוצץ ואומר שאינו מועיל, בשביל כך אין מביאים אותו, שאין בור ירא חטא וכן בכל החקים, אבל האשם אצל הישרים רצון לפני המקום, שמתכפרין בו עונותיהם. --אבן עזרא, משלי יד:ט And it's specifically the קרבן אשם that the fool treats cynically. There is a difference between a חטאת and an אשם. {:he} ><b>כז</b> ואם נפש אחת תחטא בשגגה מעם הארץ; בעשתה אחת ממצות ה׳ אשר לא תעשינה ואשם׃ <b>כח</b> או הודע אליו חטאתו אשר חטא והביא קרבנו שעירת עזים תמימה נקבה על חטאתו אשר חטא׃ --ויקרא פרק ד {:he} ><b>יז</b> ואם נפש כי תחטא ועשתה אחת מכל מצות ה׳ אשר לא תעשינה; ולא ידע ואשם ונשא עונו׃ <b>יח</b> והביא איל תמים מן הצאן בערכך לאשם אל הכהן; וכפר עליו הכהן על שגגתו אשר שגג והוא לא ידע ונסלח לו׃ <b>יט</b> אשם הוא; אשם אשם לה׳׃ --ויקרא פרק ה The חטאת is brought to atone for a sin done negligently, בשגגה. A קרבן חטאת is a שעירת עזים, which is much cheaper (the gemara says it's as little as a דַּנְקָא‎, 1\/24th of a shekel or 1\/48th of the קרבן אשם). That seems backwards: the penalty is greater if you're not sure if the sin even happened. {:he} >טעם אשם תלוי, מפני שבעליו סבור שאין עליו עונש כי לא נודע שחטא, מפני זה החמיר עליו הכתוב בספקו יותר מודאו, והצריכו איל בכסף שקלים, ואלו נודע חטאו היה מביא חטאת בת דנקא. --רמב״ן, ויקרא ה:טו {:he} >ונראה כי שם אשם מורה על דבר גדול אשר העושהו יתחייב להיות שמם ואבד בו...והחטאת מורה על דבר שנטה בו מן הדרך מלשון (שופטים כ:טז) אֶל הַשַּׂעֲרָה וְלֹא יַחֲטִא... --הטור הארוך, ויקרא ה:טו So we connect לץ with מרמה, cynicism with not caring about the truth. The problem is more than foolishness; it is a case of *intentionally* not having intention. You have to care.
