When Abraham goes to live with the Philistines, he tells them Sarah is his sister. Avimelech questions him on his dishonesty, and Abraham explains: <blockquote lang=he><p> <b>ט</b> ויקרא אבימלך לאברהם ויאמר לו מה עשית לנו ומה חטאתי לך כי הבאת עלי ועל ממלכתי חטאה גדלה; מעשים אשר לא יעשו עשית עמדי׃ <b>י</b> ויאמר אבימלך אל אברהם; מה ראית כי עשית את הדבר הזה׃ <b>יא</b> ויאמר אברהם כי אמרתי רק אין <em>יראת אלקים</em> במקום הזה; והרגוני על דבר אשתי׃ </p> <footer class=source>בראשית פרק כ</footer></blockquote> What is יראת אלקים that Abraham is so concerned about? It seems that this was something that Abraham expected them to have, but the Philistines fell short. Why should a pagan like Avimelech have fear of G-d? The phrase יראת אלקים actually has a very specific meaning in the Torah: <blockquote lang=he><p><b>יז</b> ויאסף אתם אל משמר שלשת ימים׃ <b>יח</b> ויאמר אלהם יוסף ביום השלישי זאת עשו וחיו; <em>את האלקים אני ירא</em>׃</p> <footer class=source>בראשית פרק מב </footer></blockquote> <blockquote lang=he><p><b>טז</b> ויאמר בילדכן את העבריות וראיתן על האבנים; אם בן הוא והמתן אתו ואם בת הוא וחיה׃ <b>יז</b> <em>ותיראן המילדת את האלקים</em> ולא עשו כאשר דבר אליהן מלך מצרים; ותחיין את הילדים׃</p> <footer class=source>שמות פרק א</footer></blockquote> <blockquote lang=he><p><b>יז</b> זכור את אשר עשה לך עמלק בדרך בצאתכם ממצרים׃ <b>יח</b> אשר קרך בדרך ויזנב בך כל הנחשלים אחריך ואתה עיף ויגע; <em>ולא ירא אלקים׃</em></p> <footer class=source>דברים פרק כה</footer></blockquote> In all these cases, at the level of פשט, the ones who have or are called out for lacking יראת אלקים are non-Jews. This יראת אלקים is what we would call "basic decency". There is an expectation that everyone, not just those who are commanded by G-d, to be just and moral. Note that there does not seem to be a sense of מצוה here. We have the idea of שבעה מצוות בני נח, but this seems to be more fundamental than that. One of those מצוות בני נח is to establish דינים, to enforce justice, but where does the justice come from? <hr/> In the Talmud, this is called "דרך ארץ": <blockquote lang=he><p>רבי אלעזר בן עזריה אומר אם אין תורה אין דרך ארץ אם אין דרך ארץ אין תורה .</p> <footer class=source>משנה אבות ג:יז </footer></blockquote> <blockquote lang=he><p>א״ר ישמעאל בר רב נחמן עשרים וששה דורות קדמה דרך ארץ את התורה. הה״ד (בראשית ג) לשמור את דרך עץ החיים דרך זו דרך ארץ ואח״כ עץ החיים זו תורה.</p> <footer class=source>ויקרא רבה (וילנא) פרשת צו פרשה ט סימן ג </footer></blockquote> The Maharal explains what דרך ארץ is: <blockquote lang=he><p>...דרך ארץ, שהוא הנהגה שהוא ראוי לאדם, ואין בזה דברי מוסר שהם קשים על האדם רק הדרך שנוהגים בני אדם והם דרך חכמים, והם נקראים דרך ארץ. וכמו כל המסכתא של דרך ארץ שהוא ההנהגה הישרה והטובה. והנראה מה שנקרא דרך ארץ ולא דרך עולם, מפני כי הארץ היא ישוב במני אדם ומי שאין נוהג בדרך זה אינו מין הישוב...</p> <p>ומזה נלמד כי דרך ארץ יסוד לתורה שהוא דרך עץ החיים, והוא ית׳ יתן חלקנו עם השומרים דרך עץ החיים.</p> <footer class=source>מהר״ל, נתיבות עולם, נתיב דרך ארץ א</footer></blockquote> Rav Hutner, after discussing the עשרה מאמרות of creation that represent the (involuntary) laws of nature and the עשרה דברות of the Torah that represent the (voluntary) laws of behavior, discusses the idea that there is something in between: <blockquote lang=he><p>בין רצון-מתן-הכרח דמאמרות ובין רצון-מתן-חרות דדברות, ישנו רצון ממוצע הנמצא בין הרצון דמאמרות ובין הרצון דדברות. הרצון הממוצע הזה הוא הרצון של ”קיום-העולם“. כי על כן העולם המופיע לעיני האדם כמתן-הכרח, מטיל על האדם חובה של חרות לקיימו ולא להשחיתו. כלומר, הרצון המחייב את האדם לקיים את העולם ומלהמנע להשחתה, פועל הוא אמנם את פעולתו בדרך מתן-חרות, שהרי ביד האדם לקבלו או לדחותו, ואף על פי כן נובע הוא הרצון הזה ממאמרות בראשית שכל פעולתם הוא דרך מתן-הכרח. מחיית העולם על ידי המבול באה היא כחרטה על מאמרות בראשית...ותכונת המיצוע שיש ברצון הזה הוא הוא המיחדו לרשות מיוחדת, וקובע לו שם לעצמו: ”דרך ארץ“. והיינו שאמרו חכמים כי הכ״ו דורות שעד מעמד הר סיני היו בבחינת דרך ארץ קדמה לתורה. כלומר, כשם שהרצון של דרך ארץ הוא מעצמיותו ממוצע בין הרצון דמאמרות ובין הרצון דדברות, כמו כן אותם הדורות שבאו לעולם בתקופה זו שבין המאמרות לדברות היו דורות של תקופת דרך ארץ.</p> <footer class=source>פחד יצחק, חנוכה ז:ז</footer></blockquote> <hr/> So דרך ארץ is inherent in creation. This idea, that there is a morality that is inherent in nature, and therefore that can be derived from nature and from rational thought, is called in philosophy, "natural law". It's how atheist philosophers understand ethics. It goes back to Greek and Roman thinkers: <blockquote lang=en><p>There is a true law, a right reason, conformable to nature, universal, unchangeable, eternal, whose commands urge us to duty, and whose prohibitions restrain us from evil. Whether it enjoins or forbids, the good respect its injunctions, and the wicked treat them with indifference. This law cannot be contradicted by any other law, and is not liable either to derogation or abrogation. Neither the senate nor the people can give us any dispensation...this universal law must for ever reign, eternal and imperishable. </p> <footer class=source><a href="http://oll.libertyfund.org/titles/546#Cicero_0044-01_546">Cicero, <cite>On The Commonwealth</cite>, III:xxii</a></footer></blockquote> Marvin Fox, in <a href="https://www.amazon.com/Interpreting-Maimonides-Methodology-Metaphysics-Philosophy/dp/0226259420"><cite>Interpreting Maimonides</cite></a>, points out that natural law is an important part of Christian ethics: <blockquote lang=en><p><b>Q. 90, a. 3</b> The natural law is promulgated by the very fact that G-d instilled it into man's mind so as to be known by him naturally.</p> ... <p><b>Q 91, a. 2</b> A gloss on Rm. 2:14: "When the Gentiles, who have not the law, do by nature those things that are of the law," comments as follows: "Although they have no written law, yet they have the natural law, whereby each one knows, and is conscious of, what is good and what is evil."</p> <footer class=source><a href="http://dhspriory.org/thomas/summa/FS/FS090.html#FSQ90A4THEP1">Thomas Aquinas, <cite>Summa Theologica</cite>,First Part of the Second Part</a></footer></blockquote> <blockquote lang=en><p>The one instance of law that is not natural and not rational (and, therefore, not binding) [to Aquinas] is the Old Law, the law of what is for him the Old Testament. Some of its precepts happen to accord with the natural law, and everyone is bound to observe these just because they are natural law, but not because they are contained in the Old Law. All the rest is a peculiar kind of law. It is not natural, not in accord with reason, and is binding only the Jews of pre-Christian times...[T]o observe any of the precepts of the Old Law because one believes them to have derived their binding force from the fact they are contained in the Hebrew Scriptures would be a mortal sin.</p> ... <p>The judicial precepts may be observed if they seem to be useful, but only so long as they are not considered to have any obligatory element based on their biblical source.</p> <footer class=source><a href="https://www.amazon.com/Interpreting-Maimonides-Methodology-Metaphysics-Philosophy/dp/0226259420">Marvin Fox, <cite>Interpreting Maimonides</cite></a>, pp. 144-145</footer></blockquote> However, he argues that it is not part of Jewish thinking. Ethics must be <em>commanded</em>; if we pretend to derive them scientifically we are only reflecting our own biases and our own sense of normality, which comes from the society in which we live. <blockquote lang=he><p>כל המקבל שבע מצוות ונזהר לעשותן, הרי זה מחסידי אומות העולם ויש לו חלק לעולם הבא; ו<em>הוא שיקבל אותן ויעשה אותן מפני שציווה בהן הקדוש ברוך הוא</em> בתורה והודיענו על ידי משה רבנו שבני נוח מקודם נצטוו בהן׃ אבל אם עשאן מפני הכרע הדעת אין זה גר תושב ואינו מחסידי אומות העולם (אלא) [ולא] מחכמיהם׃</p> <footer class=source>משנה תורה, הלכות מלכים ומלחמות ח:יד</footer></blockquote> Fox argues that, based on his understanding of the Rambam, the correct reading is ולא. <blockquote lang=en><p>Maimonides holds that moral claims are never open to rational argument or demonstration. They are "propositions which are known and require no proof for their truth" (<cite>Maimonides' Treatise on Logic</cite>, chap.8)...[M]oral rules are only true in the sense that in a well-ordered society they are generally accepted and not subject to doubt. They are "<em>conventions</em>, as when we know that uncovering the privy parts is ugly, or that compensating a benefactor generously is beautiful". Society, properly governed, forms our tastes and patterns of response in such a way that we have no doubt about such matters.</p> <footer class=source><a href="https://www.amazon.com/Interpreting-Maimonides-Methodology-Metaphysics-Philosophy/dp/0226259420">Marvin Fox, <cite>Interpreting Maimonides</cite></a>, pp. 133-134</footer></blockquote> <hr/> Rabbi Lichtenstein, in his seminal article, <a href="https://docs.google.com/open?id=0B-jYqnKwq_lTRmlnNndZVTJpbmM">"Does Jewish Tradition Recognize an Ethic Independent of Halacha?"</a> disagrees. I assume he is not arguing with the Rambam, but would understand the Rambam to allow for a natural law despite Rabbi Fox's arguments. When Abraham argues with ה׳ about destroying Sedom, he claims that ה׳ must act justly: <blockquote lang=he><p>חללה לך מעשת כדבר הזה להמית צדיק עם רשע והיה כצדיק כרשע; חללה לך השפט כל הארץ לא יעשה משפט׃</p> <footer class=source>בראשית יח:כה</footer></blockquote> Therefore, justice must be inherent in world. You cannot argue that G-d is <em>commanded</em> to obey His commands. He then brings all the statements we quoted about about דרך ארץ קדמה לתורה. <blockquote lang=en><p>Any supposed traditional rejection of <i lang=la>lex naturalis</i> cannot mean, therefore, that apart from Halacha--or to put it broader perspective,that in the absence of divine commandment--man and the world are amoral. Nor does it entail a total relativism or the view (evidently ascribed to Maimonides by Professor Fox) that social convention and/or utility are the sole criteria for action. At most, the Rabbis rejected natural law, not natural morality. They may conceivably have felt one could not ground specific binding and universal rules in nature but they hardly regarded uncommanded man as ethically neutral.</p> <footer class=source>Rabbi Lichtenstein, idem, p. 64</footer></blockquote> The כתוב השלישי ויכריע ביניהם is, I think, the words of Rav Hutner. <blockquote lang=he><p>וירא אלקים את כל אשר עשה והנה טוב מאד; ויהי ערב ויהי בקר יום הששי׃</p> <footer class=source>בראשית א:לא </footer></blockquote> <blockquote lang=he><p>הרצון המחייב את האדם לקיים את העולם ומלהמנע להשחתה, פועל הוא אמנם את פעולתו בדרך מתן-חרות, שהרי ביד האדם לקבלו או לדחותו, ואף על פי כן נובע הוא הרצון הזה ממאמרות בראשית שכל פעולתם הוא דרך מתן-הכרח.</p> <footer class=source>פחד יצחק, חנוכה ז:ז</footer></blockquote> There is an ethic inherent in creation, but it is only ethical--it imposes a duty of behavior on us--because creation itself is commanded. G-d said that creation is Good, and therefore we must act in a way to preserve it. As the Maharal said, מי שאין נוהג בדרך זה אינו מין הישוב. So while Halacha is deontological, דרך ארץ is consequentialist. There are no "specific binding and universal rules in nature" but G-d commands us to respect His work. <hr/> But it has to be grounded in literally יראת אלקים. Without this background of "commandedness", we cannot expect morality: <blockquote lang=he><p><em>ויאמר אברהם כי אמרתי רק אין יראת אלהים במקום הזה</em>: הודיע לו שגם אם נראה איש...שהוא פילוסוף גדול וחקק לו נמוסים ישרים, והרגיל א״ע במדות טובות ע״פ עצת שכלו, והוא עושה משפט וצדקה הכל עפ״י עצת שכלו, בכ״ז לא נוכל לבטוח על האיש ההוא...שבעת תסיתהו תאותו לעשות רע שתמיד יגבר שכלו על תאותו...רק כח אחד נמצא בנפש האדם אשר בו נוכל לבטוח שלא נחטא, והיא מדת היראה השתולה בנפש. </p> <footer class=source>מלבי״ם, בראשית כ:יא </footer></blockquote> This is highlighted by one more use of the phrase יראת אלקים in our parasha: <blockquote lang=he><p><b>יא</b> ויקרא אליו מלאך ה׳ מן השמים ויאמר אברהם אברהם; ויאמר הנני׃ <b>יב</b> ויאמר אל תשלח ידך אל הנער ואל תעש לו מאומה; כי עתה ידעתי כי <em>ירא אלקים</em> אתה ולא חשכת את בנך את יחידך ממני׃ <footer class=source>בראשית פרק כב</footer></blockquote> As Rabbi Leibtag <a href="http://tanach.org/breishit/vayera2.txt">points out</a>, the concept of יראת אלקים here seems incongruous. We've been translating it as a sort of natural morality, and, as Alex Ozar <a href="http://www.torahmusings.com/2013/06/rabbi-david-hartmans-theological-legacy/">puts it</a>, "If there is anything man knows, it is that it is rather unseemly to murder one’s son in cold blood". How can this be called יראת אלקים? Rabbi Leibtag would read the ו in ולא not as "and" but rather as "but": "Now I know that even though you are a ירא אלקים, you have a sense of morality that is consistent with the preservation of civilization, you are still willing to obey me." And that, I think, is the final lesson of the Akeidah. "Natural law" has no ethical force if it is not commanded by הקב״ה, and so the actual law of the Torah has to trump our internal vague sense of morality.
