After the drama of the deaths of Nadav and Avihu, Aharon is commanded not to get drunk: <blockquote lang=he><p><b>ח</b> וידבר ה׳ אל אהרן לאמר׃ <b>ט</b> יין ושכר אל תשת אתה ובניך אתך בבאכם אל אהל מועד ולא תמתו; חקת עולם לדרתיכם׃ <b>י</b> ולהבדיל בין הקדש ובין החל ובין הטמא ובין הטהור׃ <b>יא</b> ולהורת את בני ישראל את כל החקים אשר דבר ה׳ אליהם ביד משה׃</p> <footer class=source>ויקרא פרק י</footer></blockquote> I want to focus on a minor point, the wording of להבדיל בין הקדש ובין החל. The Avudraham says this is the basis of our wording in havdalah: <blockquote lang=he><p>ואומר: אתה אמרת להבדיל בין קדש לחול שנא׳ ולהבדיל בין הקדש ובין החול. ובין אור לחשך שנאמר ויבדל אלהים בין האור ובין החשך והאור נברא במוצאי שבת. ובין ישראל לעמים שנא׳ ואבדיל אתכם מן העמים להיות לי .</p> <footer class=source>ספר אבודרהם סדר מוצאי שבת </footer></blockquote> But note that the wording in our havdalah is not exactly the same as the pasuk. The Shulchan Aruch uses the wording of the pasuk, while the Rema uses the Avudraham's wording: <blockquote lang=he><p>אסור לעשות שום מלאכה קודם שיבדיל, ואם הבדיל בתפלה מותר אף על פי שעדיין לא הבדיל על הכוס. ואם צריך לעשות מלאכה קודם שהבדיל בתפלה אומר: המבדיל <em>בין הקודש ובין החול</em> בלא ברכה, ועושה מלאכה. הגה: וכן נשים שאינן מבדילין בתפלה יש ללמדן שיאמרו המבדיל <em>בין קודש לחול</em> קודם שיעשו מלאכה (כל בו) </p> <footer class=source>שולחן ערוך אורח חיים הלכות שבת סימן רצט סעיף י </footer></blockquote> <hr/> Rabbi Yaakov Kamenetsky explains why the wording isn't exactly the same. We say בין קודש לחול where the pasuk says בין הקודש ובין החול. He says this is due to the difference between the language of תנ״ך and the language of חז״ל: <blockquote lang=he><p>הנה וזהו סגנון המקרא, דהיינו כל פעם שרוצה לחלק בין שני ענינים, מַבדילָם הכתוב על ידי שני פעמים ”ביו“, כגון ”בין האור ובין החשך“, ”בין הקדש ובין קדש הקדשים“, ”ובין החיה הנאכלת ובין החיה אשר לא תאכל“. אבל לשון חז״ל אינו כן, אלא תמיד הם נבדלים ע״י ”בין“ אחד, כמו ”המבדיל בין קדש לחול בין אור לחשך בין ישראל לעמים“, והיינו שהפחות נבדל מהראשון ע״י אות למ״ד.</p> <footer class=source>אמת ליעקב, שמיני, עמ׳ שס״ג</footer></blockquote> Rabbi Kamenetsky goes on to point out other places where the שולחן ערוך uses biblical language in ברכות where the רמ״א uses Mishnaic Hebrew, and hypothesizes that the מחבר would use the language of תנ״ך for ברכות on מציוות דאורייתא. I'm not going to go into that now. But I find interesting this idea that language, even לשון הקדש, changes with time. This comes up in the Gemara: <blockquote lang=he><p>כי סליק איסי בר היני אשכחיה לר׳ יוחנן דקא מתני ליה לבריה ”רחלים“. אמר ליה: אתנייה ”רחלות“. א״ל כדכתיב (בראשית לב) ”רחלים מאתים“! אמר ליה: לשון תורה לעצמה לשון חכמים לעצמן.</p> <footer class=source>חולין קלז,ב</footer></blockquote> And even the meanings of words change: <blockquote lang=he><p>בעא מיניה ר׳ אסי מר׳ יוחנן: יין שמסכו עובד כוכבים מהו? א״ל: ואימא ”מזגו“! א״ל: אנא כדכתיב קאמינא (משלי ט:ב) טבחה טבחה מסכה יינה. א״ל: לשון תורה לעצמה לשון חכמים לעצמו.</p> <footer class=source>עבודה זרה נח,ב</footer></blockquote> <blockquote lang=he><p><b>א</b> חָכְמוֹת בָּנְתָה בֵיתָהּ; חָצְבָה עַמּוּדֶיהָ שִׁבְעָה׃<br/> <b>ב</b> טָבְחָה טִבְחָהּ מָסְכָה יֵינָהּ; אַף עָרְכָה שֻׁלְחָנָהּ׃</p> <footer class=source>משלי פרק ט</footer></blockquote> <blockquote lang=en><p>His point is that in the language of the Rabbis <i lang=he>mazag</i> has the signification to mix wine with water; but <i lang=he>masak</i>, while having that meaning in Biblical Hebrew, means in Rabbinic Hebrew to mix strong wine with weaker wine.</p> <footer class=source><a href="http://halakhah.com/zarah/zarah_58.html#58b_9">Soncino Translation, idem., note 9</a></footer></blockquote> All languages change with time, but Hebrew specifically, as the language of the Jews, has been through drastic disruptions that it had to be virtually re-invented after the return to Israel: <blockquote lang=he><p><b>כג</b> גם בימים ההם ראיתי את היהודים השיבו נשים אשדודיות (אשדדיות) עמוניות (עמניות) מואביות׃ <b>כד</b> ובניהם חצי מדבר אשדודית ואינם מכירים לדבר יהודית וכלשון עם ועם׃</p> <footer class=source>נחמיה פרק יג</footer></blockquote> (This is similar to the re-invention of Hebrew by Eliezer Ben‑Yehuda about a century ago. It's why I can read Ramban but not HaAretz. לשון תורה לעצמה לשון מדינת ישראל לעצמה.) <hr/> And language changes even over relatively short periods of time. Compare במדבר to יהושוע (written about 2 decades later): <blockquote lang=he><p>ויסעו מרעמסס בחדש הראשון בחמשה עשר יום לחדש הראשון; <em>ממחרת הפסח</em> יצאו בני ישראל ביד רמה לעיני כל מצרים׃</p> <footer class=source>במדבר לג:ג</footer></blockquote> <blockquote lang=he><p><b>יא</b> ויאכלו מעבור הארץ <em>ממחרת הפסח</em> מצות וקלוי; בעצם היום הזה׃ <b>יב</b> וישבת המן ממחרת באכלם מעבור הארץ ולא היה עוד לבני ישראל מן; ויאכלו מתבואת ארץ כנען בשנה ההיא׃ </p> <footer class=source>יהושוע פרק ה</footer></blockquote> The problem is that the Jews left Egypt ממחרת הפסח, after the night of the Paschal sacrifice and the first seder, on the 15th of Nisan. They started eating the produce of the land after the Omer offering, on the 16th. How could this be called ממחרת הפסח? Tosaphot explains that the word פסח changed: in the Torah it referred to the holiday of the 14th, when the sacrifice was offered. The next seven days were חג המצות. Later, the focus was on the yom tov, so the 14th was ערב פסח and חג הפסח started on the 15th. <blockquote lang=he><p> הקשה ה״ר אברהם אבן עזרא היכי אמרינן ממחרת הפסח דהכא הוי ששה עשר בניסן שנקרב העומר דלמא ממחרת הפסח ממחרת שחיטת הפסח קאמר דהיינו ט״ו בניסן שעדיין לא נקרב העומר...ור״י מפרש נהי דבעלמא ממחרת הפסח הוי ט״ו הכא; ר״ל ט״ז <em>ולשון התורה לחוד ולשון נביאים לחוד ולשון חכמים לחוד</em>. </p> <footer class=source>תוספות, קידושין לז,ב , ד״ה ממחרת הפסח אכול מעיקרא לא אכול</footer></blockquote> <hr/> So Hebrew has undergone huge changes over the centuries. <blockquote lang=he><p>שינוי עצום נתחולל בתחום הפועל, שינוי גדול כל כך, עד שבגללו כבר קשה להניח, כי יהודי בן תקופת דוד המלך היה מבין את לשונו של יהודי בן תקופת רבי יהודה הנשיא.</p> <footer class=source><a href="http://www.daat.ac.il/daat/kitveyet/mahanaim/lashon-2.htm">פרופ׳ יחזקאל קוטשר, <cite>לשון המשנה והתלמוד</cite></a></footer></blockquote> <hr/> This is all interesting if you are a linguist, but for those of us who attempt to obey ה׳'s word, it produces an epistemological crisis: How can we do מצוות if we don't know what they mean? Look at the end of this week's parasha: <blockquote lang=he><p><b>יג</b> ואת אלה תשקצו מן העוף לא יאכלו שקץ הם; את הנשר ואת הפרס ואת העזניה׃ <b>יד</b> ואת הדאה ואת האיה למינה׃ <b>טו</b> את כל ערב למינו׃ <b>טז</b> ואת בת היענה ואת התחמס ואת השחף; ואת הנץ למינהו׃ <b>יז</b> ואת הכוס ואת השלך ואת הינשוף׃ <b>יח</b> ואת התנשמת ואת הקאת ואת הרחם׃ <b>יט</b> ואת החסידה האנפה למינה; ואת הדוכיפת ואת העטלף׃ <b>כ</b> כל שרץ העוף ההלך על ארבע שקץ הוא לכם׃</p> <footer class=source>ויקרא פרק יא</footer></blockquote> We don't know any of these birds. There are lots of commentaries, but they amount to little more than guesses. The answer within the halachic system is מסורה. <blockquote lang=he><p>שתי מסורות ישנן: א) מסורה אחת המתיחסת כולה למסורה של לימוד, ויכוח, משא ומתן והוראה שכלית...ב) מסורת מעשית של הנהגת כלל ישראל בקיום מצוות וזו מיסדת על הפסוק ”שאל אביך ויגדך זקניך ויאמרו לך“. </p> <footer class=source>הרב וסף דוב הלוי סולובייצ׳יק, שיעורים לזכר אבא מרי ז״ל, חלק א׳ עמ׳ רמ״ט</footer></blockquote> This is more than the idea that, if we have a continuous chain of transmission of a word, then its current meaning must be the same as its ancient one. This is clearly not true; language changes even without the disruptions that characterize Jewish history. מסורה, the transmission of תורה שבעל פה, is an epistemological statement. It <em>defines</em> how we know what words mean. That is an inherent part of the belief in תורה שבעל פה. With regard to out nonkosher bird list, the מסורה has not preserved their meaning. All we have is a מסורה of which birds are <em>not</em> on the list. <blockquote lang=en><p>How do we know which animals and birds are kosher? Regarding animals, the Torah provides two physical indicia. Any animal that has split hooves and chews its cud is kosher. All others are not. Thus, sheep, goat, cow, deer, buffalo, gazelle, and giraffe are kosher; pig, camel and llama are not.</p> <p>Regarding birds, the situation is much more complex. The Torah lists twenty-four species that are non-kosher. All others are acceptable. Thus, in theory, if a person knew the precise identity of all twenty-four listed birds, all others are acceptable. Today we no longer know what those birds are. This is the reason that both Rabbi Samson Raphael Hirsch and Artscroll chose to transliterate rather than attempt to translate the names of the birds in their Torah translations. Because of this, for close to one thousand years, the overriding principle is “Tradition!” The only birds that are treated as kosher are those for which a reliable tradition exists that in the previous generation it was treated as kosher.</p> ... <p>We found an impressively comprehensive article by Professor Yehuda Felix, then at Bar Ilan University, in which he traced the halachic history of the pasyon (the Hebrew word for pheasant) for nearly 1500 years, and shows that it was always treated as a kosher bird. But names are insufficient--there is no way of knowing that the bird called “pasyon” 500 years ago is the same bird called “pasyon” today. </p> ... <p> In order to stem the loss of traditions, we decided to organize a dinner in which we would serve all known kosher birds and as many types of animals as possible.</p> ... <p>The purpose of this dinner was to transmit the traditions. To accomplish that we needed participants. Who would come? It turned out that was not a problem. We were over-subscribed before we realized it. We also succeeded in persuading some of the most important rabbis and researchers involved in the field to join us. They came from New York, Basel, and all over Israel. At the end, nearly one hundred people, <i lang=he>Ashkenazim</i>, <i lang=he>Sephardim</i>, and <i lang=he>Teimanim</i>, jammed the restaurant to hear two hours of <i lang=he>shiurim</i> and partiake of thirteen courses. The <i lang=he>shiurim</i> covered the relevant topics of the evening; <i lang=he>kashrus</i> of birds in general and game birds in particular, <i lang=he>kashrus</i> of waterfowl, need for a <i lang=he>mesora</i> for animals, anatomic signs of animals, and <i lang=he>kashrus</i> of locusts.</p> ... <p>The main purpose of this dinner was the preservation and transmission of <i lang=he>mesoros</i>. As Rabbi Kafich had explained all those years ago, that cannot be done via a name or something on a dinner plate. For that purpose, we needed to find real animals again. Present at the dinner were live grasshoppers, a pair of quails, a guinea fowl, muscovy duck and several sparrows. A taxidermied pheasant and partridge were also present. Each of these was displayed, described, and discussed. Those birds participated in the historic process of transmitting the traditions to a room full of people, satiated both physically and spiritually.</p> <footer class=source>Rabbi Ari Z. The מסורה is not, at its core, a way to tell us what the Torah meant 3500 years ago. It tells us what the Torah means today and connects <em>us</em> to מעמד הר סיני ‎ 3500 years ago.
