<p>What's the point of the mitzvot? Is the Torah just the mother of all Powerpoint presentations, a 613-item bullet list that we have to check off unthinkingly, item by item? Or can we learn a deeper message from the commandments?</p> <p>A classic example from this week's parasha:</p> <blockquote lang=he><p><b>ו</b> כי יקרא קן צפור לפניך בדרך בכל עץ או על הארץ אפרחים או ביצים והאם רבצת על האפרחים או על הביצים לא תקח האם על הבנים׃ <b>ז</b> שלח תשלח את האם ואת הבנים תקח לך למען ייטב לך והארכת ימים׃</p> <footer class=source>דברים פרק כב</footer></blockquote> <p>And we will be referring to a similar halacha in Vayikra:</p> <blockquote lang=he><p>ושור או שה אתו ואת בנו לא תשחטו ביום אחד׃</p> <footer class=source>ויקרא כב:כח</footer></blockquote> <p>Why should we send away the mother bird? Do we feel sorry for her? The Mishna seems to address this:</p> <blockquote lang=he><p>האומר על קן צפור יגיעו רחמיך ועל טוב יזכר שמך מודים מודים משתקין אותו.</p> <footer class=source>משנה ברכות ה:ג</footer></blockquote> <blockquote lang=he><p>על קן צפור יגיעו רחמיך מ"ט פליגי בה תרי אמוראי במערבא רבי יוסי בר אבין ורבי יוסי בר זבידא חד אמר מפני שמטיל קנאה במעשה בראשית וחד אמר מפני שעושה מדותיו של הקדוש ברוך הוא רחמים ואינן אלא גזרות</p> <footer class=source>ברכות לג,ב</footer></blockquote> <p>First, what is קנאה במעשה בראשית? I don't think that we are concerned that the lizards will hear our prayer about the birds and get jealous. I think the problem is picking our praises of ה׳ from an infinite list, as the gemara goes on to say:</p> <blockquote lang=he><p>ההוא דנחית קמיה דר׳ חנינא אמר הקל הגדול הגבור והנורא והאדיר והעזוז והיראוי החזק והאמיץ והודאי והנכבד המתין לו עד דסיים כי סיים א״ל סיימתינהו לכולהו שבחי דמרך למה לי כולי האי אנן הני תלת דאמרינן אי לאו דאמרינהו משה רבינו באורייתא ואתו אנשי כנסת הגדולה ותקנינהו בתפלה לא הוינן יכולין למימר להו ואת אמרת כולי האי ואזלת משל למלך בשר ודם שהיו לו אלף אלפים דינרי זהב והיו מקלסין אותו בשל כסף והלא גנאי הוא לו</p> <footer class=source>שם</footer></blockquote> <p>But be that as it may, the Rambam brings the second opinion <i lang=he>l'halacha</i>:</p> <blockquote lang=he><p>כל האומר בתחנונים, מי שריחם על קן ציפור שלא ייקח האם על הבנים, או שלא ישחוט אותו ואת בנו ביום אחד, ירחם עלינו, וכיוצא בעניין זה--משתקין אותו, מפני שמצוות אלו גזירת הכתוב הן, ואינם רחמים: שאילו היו מפני הרחמים, לא התיר לנו שחיטה כל עיקר. וכן לא ירבה בכינויין של שם ויאמר "הקל הגדול הגיבור, והנורא" (דברים י,יז; נחמיה ט,לב) החזק והאמיץ והעיזוז, שאין כוח באדם להגיע סוף שבחו של הקדוש ברוך הוא--אלא אומר, מה שאמר משה רבנו.</p> <footer class=source>רמב״ם משנה תורה הלכות תפילה ט:ז</footer></blockquote> <p>Which would seem to settle the question. But the idea that the <i lang=he>halacha</i> has no discernable reason, contradicts many commentators, including the Rambam himself in the מורה נבוכים:</p> <blockquote><p>The commandment concerning the killing of animals is necessary, because the natural food of man consists of vegetables and of the flesh of animals: the best meat is that of animals permitted to be used as food. No doctor has any doubts about this. Since, therefore, the desire of procuring good food necessitates the slaying of animals, the Law enjoins that the death of the animal should be the easiest. It is not allowed to torment the animal by cutting the throat in a clumsy manner, by poleaxing, or by cutting off a limb whilst the animal is alive.</p> <p>It is also prohibited to kill an animal with its young on the same day (Lev. xxii. 28), in order that people should be restrained and prevented from killing the two together in such a manner that the young is slain in the sight of the mother; for the pain of the animals under such circumstances is very great. There is no difference in this case between the pain of man and the pain of other living beings, since the love and tenderness of the mother for her young ones is not produced by reasoning, but by imagination, and this faculty exists not only in man but in most living beings...</p> <p>The same reason applies to the law which enjoins that we should let the mother fly away when we take the young... If the Law provides that such grief should not be caused to cattle or birds, how much more careful must we be that we should not cause grief to our fellowmen. When in the Talmud (Ber. p. 33b) those are blamed who use in their prayer the phrase, "Thy mercy extendeth to young birds," it is the expression of the one of the two opinions mentioned by us, namely, that the precepts of the Law have no other reason but the Divine will. We follow the other opinion.</p> <footer class=source><cite>Guide for the Perplexed</cite>, 3:48, <a href="http://www.amazon.com/gp/product/1619492385/ref=as_li_ss_tl?ie=UTF8&camp=1789&creative=390957&creativeASIN=1619492385&linkCode=as2&tag=bililitecom-20">Friedlander translation</a><img src="http://www.assoc-amazon.com/e/ir?t=bililitecom-20&l=as2&o=1&a=1619492385" width="1" height="1" border="0" alt="" style="border:none !important; margin:0px !important;" /></footer> </blockquote> <p>And the Rambam expands this concept, "If the Law provides that such grief should not be caused to cattle or birds, how much more careful must we be that we should not cause grief to our fellowmen", in <i lang=he>Hichot Deot</i>:</p> <blockquote lang=he><p><b>יא</b> ומצווין אנו ללכת בדרכים אלו הבינוניים והם הדרכים הטובים והישרים שנאמר "והלכת בדרכיו" (דברים כח:ט). כך לימדו בפירוש מצוה זו: מה הוא נקרא חנון אף אתה היה חנון; מה הוא נקרא רחום אף אתה היה רחום; מה הוא נקרא קדוש אף אתה היה קדוש׃ ועל דרך זו קראו הנביאים לאל בכל אותן הכינויין ארך אפיים ורב חסד צדיק וישר תמים גיבור וחזק וכיוצא בהן להודיע שאלו דרכים טובים וישרים הם וחייב אדם להנהיג עצמו בהן ולהידמות כפי כוחו׃</p> <p><b>יב</b> וכיצד ירגיל אדם עצמו בדעות אלו עד שייקבעו בו יעשה וישנה וישלש במעשים שעושה על פי הדעות האמצעייות ויחזור בהן תמיד עד שיהיו מעשיהן קלים עליו ולא יהיה בהם טורח וייקבעו הדעות בנפשו׃</p> <p><b>יג</b> ולפי שהשמות האלו שנקרא בהן היוצר הן הדרך הבינונית שאנו חייבין ללכת בה נקראת דרך זו דרך ה׳׃ והיא שלימדה אברהם אבינו לבניו שנאמר "כי ידעתיו למען אשר יצווה את בניו ואת ביתו אחריו ושמרו דרך ה׳ לעשות צדקה ומשפט" (בראשית יח:יט)׃</p> <footer class=source>רמב״ם משנה תורה הלכות דעות א</footer></blockquote> <p>So how to resolve the contradiction? The Tosphot Yom Tov on our Mishna suggests that there is a difference between davening and learning:</p> <blockquote lang=he><p>...וטעמייהו דוקא בתפילה שכשאומר בתפילה מחליט הדבר ולהכי משתקין אותו מה שאין כן דרך דרש או פשט...</p> <footer class=source>תוספות יום טוב, משנה ברכות ה:ג</footer></blockquote> <p>Tefillah is when we throw ourselves before the Al-mighty; it is a time for אמונה פשוטה, not for theological or philosophical discussions. We do not analyze the reasons for G-d's commands then; we simply accept them as they are. But there is a place for that kind of analysis (for instance, 45 minutes before davening...). There's a great quote from Rabbi Adin Steinsaltz that I am sure I have read but I can't find it, so either he actually said it or I am making it up. Just substitute my name for his and it's still a good point. He was once discussing כוונה and the meaning of the davening with another rabbi, who talked about his thoughts during שמנה עשרה. He (the other rabbi) would think about the nature of ה׳ and what divinity really means, very deep concepts, and Rabbi Steinsaltz interrupted him, "That's for the cholent on Shabbos afternoon! During davening you just think about davening!" [Well after I gave this shiur, I found my source: Rabbi Shalom Carmy's masterful essay, <a href="http://traditionarchive.org/news/originals/Volume%2037/No.%201/Without%20Intelligence.pdf"><cite>Without Intelligence, Whence Prayer?</cite>, Tradition 37:1</a>, p. 3]</p> <p>The Ramban has a different approach to this mitzvah:</p> <blockquote lang=he><p> גם זו מצוה מבוארת מן אותו ואת בנו לא תשחטו ביום אחד (ויקרא כב כח) כי הטעם בשניהם לבלתי היות לנו לב אכזרי...וכתב הרב במורה הנבוכים(ג מח) כי טעם שלוח הקן וטעם אותו ואת בנו לא תשחטו ביום אחד כדי להזהיר שלא ישחוט הבן בעיני האם כי יש לבהמות דאגה גדולה בזה ואין הפרש בין דאגת האדם לדאגת הבהמות על בניהם כי אהבת האם וחנותה לבני בטנה איננו נמשך אחרי השכל והדבור אבל הוא מפעולת כח המחשבה המצויה בבהמות כאשר היא מצויה באדם...</p> <p>אבל הכל הרחקה ויותר נכון בעבור שלא נתאכזר.</p> <p>ואמר הרב ואל תשיב עלי ממאמר החכמים (ברכות לג) האומר על קן צפור יגיעו רחמיך כי זו אחת משתי סברות סברת מי שיראה כי אין טעם למצות אלא חפץ הבורא ואנחנו מחזיקים בסברא השניה שיהיה בכל המצות טעם...</p> <p>כפי דעתי ענין אחר להם שרצו לומר שאין התועלת במצות להקב״ה בעצמו יתעלה אבל התועלת באדם עצמו למנוע ממנו נזק או אמונה רעה או מדה מגונה או לזכור הנסים ונפלאות הבורא יתברך ולדעת את השם וזהו ”לצרף בהן“ שיהיו ככסף צרוף כי הצורף הכסף אין מעשהו בלא טעם אבל להוציא ממנו כל סיג וכן המצות להוציא מלבנו כל אמונה רעה ולהודיענו האמת ולזוכרו תמיד...כי המצות המעשיות כגון שחיטת הצואר ללמדנו המדות הטובות והמצות הגזירות הגדורות במינין לזקק את נפשותינו כמו שאמרה תורה (שם כ כה) ולא תשקצו את נפשותיכם בבהמה ובעוף ובכל אשר תרמוש האדמה אשר הבדלתי לכם לטמא א״כ כלם לתועלתנו בלבד...שאפילו הלולב והסוכה והתפילין שצוה בהן שיהו לאות על ידך ולזכרון בין עיניך כי ביד חזקה הוציאך ה׳ ממצרים אינן לכבוד ה׳ יתברך אבל לרחם על נפשותינו וכבר סדרו לנו בתפלת יום הכפורים אתה הבדלת אנוש מראש ותכירהו לעמוד לפניך כי מי יאמר לך מה תעשה ואם יצדק מה יתן לך וכן אמר בתורה (לעיל י יג) לטוב לך כאשר פירשתי (שם פסוק יב) וכן ויצונו ה׳ לעשות את כל החקים האלה ליראה את ה׳ אלקינו לטוב לנו כל הימים (לעיל ו כד) והכוונה בכלם לטוב לנו ולא לו יתברך ויתעלה אבל כל מה שנצטוינו שיהיו בריותיו צרופות ומזוקקות בלא סיגי מחשבות רעות ומדות מגונות.</p> <p>וכן מה שאמרו (ברכות לג) לפי שעושה מדותיו של הקב״ה רחמים ואינן אלא גזרות לומר שלא חס האל על קן צפור ולא הגיעו רחמיו על אותו ואת בנו שאין רחמיו מגיעין בבעלי הנפש הבהמית למנוע אותנו מלעשות בהם צרכנו שאם כן היה אוסר השחיטה אבל טעם המניעה ללמד אותנו מדת הרחמנות ושלא נתאכזר כי האכזריות תתפשט בנפש האדם כידוע בטבחים שוחטי השורים הגדולים והחמורים שהם אנשי דמים זובחי אדם אכזרים מאד ומפני זה אמרו (קידושין פב) טוב שבטבחים שותפו של עמלק והנה המצות האלה בבהמה ובעוף אינן רחמנות עליהם אלא גזירות בנו להדריכנו וללמד אותנו המדות הטובות...</p> <footer class=source>רמב״ן, דברים כב:ו ד״ה כי יקרא קן צפור לפניך</footer></blockquote> <p>The difference between the Rambam and the Ramban is subtle but important. For the Ramban, the commandments not to be cruel to animals is <em>not</em> out of concern for the animals themselves, but to prevent us from becoming cruel to other human beings. This has contemporary implications. In a <a href="http://torahmusings.com/2013/07/is-vegetarianism-dangerous/">post on Hirhurim</a> called "Is Vegetarianism Dangerous?", Rabbi Gil Student discusses Rav Kook's approach to being a vegetarian. While he (Rav Kook) felt that not eating meat is the messianic ideal, focusing on the rights of animals in this, imperfect, world is a dangerous thing:</p> <blockquote><p>But R. Kook cautions against a looming moral hazard. When human morality progresses to a natural revulsion from eating animals, Vegetarianism will be universally appropriate. But in this unredeemed world, adopting this stringency is wrong and dangerous. It demonstrates a moral confusion, a failure to distinguish between people and animals. When people created in the divine image are suffering, R. Kook asks, how can we focus our energies on animal rights? It is "as if we have already corrected everything, already removed the reign of wickedness, falsehood, hatred and jealousy of nations, racism and tribal fighting that leads to so many deaths and the flowing of rivers of blood--as if all this disappeared from the land and there is nothing left with which this ‘human’ moralist to become righteous other than upholding ethics with animals".</p> <p>R. Kook adds that if Vegetarianism is adopted inorganically, if the desire for meat is willfully suppressed rather than erased, then a terrifying danger exists. When the desire for flesh overwhelms someone, he will not distinguish between killing animals and humans. If all killing is equally wrong, if eating all living animals is equally wrong, then cannibalism becomes a real possibility.</p> <p>Vegetarianism risks erasing the distinction between man and beast. Animal rights are important but human rights moreso. Additionally, if animal rights are raised as a priority, some people will satisfy their instinct for generosity with animals while treating fellow people cruelly. We would find horrible humans who think they are righteous because of their kindness to animals.</p> <footer class=source><a href="http://torahmusings.com/2013/07/is-vegetarianism-dangerous/">Rabbi Gil Student, <cite>Is Vegetarianism Dangerous?</cite></a></footer></blockquote> <p>The danger is not in being a vegetarian, but in a philosophy that equates the rights of animals with those of people. The <a href="http://en.wikipedia.org/wiki/Animal_rights_and_the_Holocaust#PETA_and_the_use_of_Holocaust_imagery">2003 ad campaign by PETA</a> equating the treatment of animals with the Holocaust makes true evil seem "insignificant and banal". Instead of having the mitzvot sensitize us to understanding G-d's will and true morality, we run the risk of losing all sensitivity and meaning.</p>
