<p>פרשת תזריע continues the theme of טומאה and טהרה and its relation with the קדושה of place. צרעת is, in these terms, the most extreme form of טומאה since someone with צרעת is excluded not just from the משכן but from the entire camp of Israel. But I want to focus on a different aspect of טומאת צרעת that is also unique. </p> <blockquote lang=he><p>אדם כי יהיה בעור בשרו שאת או ספחת או בהרת והיה בעור בשרו לנגע צרעת והובא אל אהרן הכהן או אל אחד מבניו הכהנים׃</p> <footer class=source>ויקרא יג:ב</footer></blockquote> <p>Note that only a כהן can diagnose צרעת:</p> <blockquote lang=he><p><b>לד</b> כי תבאו אל ארץ כנען אשר אני נתן לכם לאחזה; ונתתי נגע צרעת בבית ארץ אחזתכם׃ <b>לה</b> ובא אשר לו הבית והגיד לכהן לאמר: כנגע נראה לי בבית׃</p> <footer class=source>ויקרא פרק יד</footer></blockquote> <blockquote lang=he><p>כֵּיצַד רְאִיַּת הַבַּיִת? <em>וּבָא אֲשֶׁר לוֹ הַבַּיִת וְהִגִּיד לַכֹּהֵן לֵאמֹר כְּנֶגַע נִרְאָה לִי בַּבָּיִת</em>, אֲפִלּוּ תַּלְמִיד חָכָם וְיוֹדֵעַ שֶׁהוּא נֶגַע וַדַּאי, לֹא יִגְזוֹר וְיֹאמַר <em>נֶגַע</em> נִרְאָה לִי בַּבָּיִת ; אֵלָּא <em>כְּנֶגַע</em> נִרְאָה לִי בַּבָּיִת.</p> <footer class=source>משנה נגעים יב:ה</footer></blockquote> <p>And it's not just that the כהן diagnoses the צרעת; the טומאה doesn't <em>exist</em> until the כהן declares it:</p> <blockquote lang=he><p>וקשה, למה אסור לומר נגע, והלא עד שיאמר הכהן טמא <em>אין כאן טומאה</em>. והר״מ פירש, משום למד לשונך לומר איני יודע, או משום דרך ארץ שצריך לנהוג עם הכהן, או כדי שלא לפתוח פיו לשטן. ולכל הטעמים נראה לי <em>דבכל הנגעים הדין כך</em>. ואפשר שלא הקפידה התורה אלא בנגע הבא עליו ראשון.</p> <footer class=source>תספות יום טוב, שם</footer></blockquote> <p>We will see how we know that עד שיאמר הכהן טמא אין כאן טומאה. But first, what does that mean--בנגע הבא עליו ראשון?</p> <blockquote lang=he><p>הצרעת הוא שם האמור בשותפות כולל עניינים הרבה שאין דומין זה לזה. שהרי לובן עור האדם קרוי צרעת. ונפילת קצת שיער הראש או הזקן קרוי צרעת. ושינוי עין הבגדים או הבתים קרוי צרעת. וזה השינוי האמור בבגדים ובבתים שקראתו תורה צרעת בשותפות השם אינו ממנהגו של עולם אלא אות ופלא היה בישראל כדי להזהירן מלשון הרע. שהמספר בלשון הרע משתנות קירות ביתו. אם חזר בו יטהר הבית. אם עמד ברשעו עד שהותץ הבית משתנין כלי העור שבביתו שהוא יושב ושוכב עליהן. אם חזר בו יטהרו. ואם עמד ברשעו עד שישרפו משתנין הבגדים שעליו. אם חזר בו יטהרו ואם עמד ברשעו עד שישרפו משתנה עורו ויצטרע ויהיה מובדל ומפורסם לבדו עד שלא יתעסק בשיחת הרשעים שהוא הליצנות ולשון הרע. ועל עניין זה מזהיר בתורה ואומר השמר בנגע הצרעת זכור את אשר עשה ה׳ אלקיך למרים בדרך.</p> <footer class=source> משנה תורה, הלכות טומאת צרעת טו:י</footer></blockquote> <p>The interpretation that צרעת comes because of לשון הרע is from ספר דברים:</p> <blockquote lang=he><p><b>ח</b> השמר בנגע הצרעת לשמר מאד ולעשות: ככל אשר יורו אתכם הכהנים הלוים כאשר צויתם תשמרו לעשות׃ <b>ט</b> זכור את אשר עשה ה׳ אלקיך למרים בדרך בצאתכם ממצרים׃</p> <footer class=source>דברים פרק כד</footer></blockquote> <blockquote lang=he><p>אם באת להזהר שלא תלקה בצרעת, אל תספר לשון הרע. זכור העשוי למרים שדברה באחיה ולקתה בנגעים.</p> <footer class=source>רש״י, דברים כד:ט, ד״ה זכור את אשר עשה ה׳ אלקיך למרים</footer></blockquote> <blockquote lang=he><p>הנה ראיה על דרש אל תקרי מצורע אלא מוציא שם רע.</p> <footer class=source>אבן עזרא, שם</footer></blockquote> <p>If you know the מפרשי תורה, this Ibn Ezra is amazing. He usually strictly deals with the פשט; here is is saying that what is a דרש in ויקרא is פשט here. </p> <p>Now, the fact that the טומאה is, in effect, created by the כהן is from the פסוק:</p> <blockquote lang=he><p>וראה הכהן את הנגע בעור הבשר ושער בנגע הפך לבן ומראה הנגע עמק מעור בשרו נגע צרעת הוא; וראהו הכהן וטמא אתו׃</p> <footer class=source>ויקרא יג:ג</footer></blockquote> <blockquote lang=he><p>יאמר לו טמא אתה...גזירת הכתוב. </p> <footer class=source>רש״י, שם, ד״ה וטמא אתו</footer></blockquote> <blockquote lang=he><p>פרוש, כתיב <em>וטימא אותו</em>, הוי ליה למכתב <em>טמא הוא</em>. מאי <em>וטמא אותו</em>? אלא שצריך לומר לו <em>טמא אתה</em> ואם לו אמר לו בזה הלשון אינו טמא, אף על גב שראה את הנגע...</p> <footer class=source>גור אריה, שם</footer></blockquote> <p>The idea that "contamination" has to be declared to exist makes no sense if we think about טומאה as a state of the person. If the lesion is צרעת, it was צרעת before the כהן came. What is going on?</p> <p>As an aside, while this idea doesn't make sense, it hasn't prevented it from infiltrating my hospital policy. In the olden days, the doctor would diagnose you with "a virus" and you would get better in a week. Now we have sophisticated DNA tests that can actually name your virus, and it only takes 7 days to get better. My hospital's infection control department decided that if a patient has a named virus, he has to be on isolation. Never. Ind that it's the same patient with the same symptoms as the previous day; yesterday he had "the common cold"--no isolation. Today he has rhinovirus--full contact isolation, gowns and gloves.</p> <p>No, it doesn't make sense. But it is how צרעת works. And more than that: we encourage the מצורע to take advantage of that:</p> <blockquote lang=he><p>וצוה הכהן ופנו את הבית בטרם יבא הכהן לראות את הנגע ולא יטמא כל אשר בבית; ואחר כן יבא הכהן לראות את הבית׃</p> <footer class=source>ויקרא יד:לו</footer></blockquote> <blockquote lang=he><p>שכל זמן שאין כהן נזקק לו, אין שם תורת טמאה: ולא יטמא כל אשר בבית. שאם לא יפנהו ויבא הכהן ויראה הנגע, נזקק להסגר, וכל מה שבתוכו יטמא. ועל מה חסה תורה, אם על כלי שטף, יטבילם ויטהרו, ואם על אוכלין ומשקין, יאכלם בימי טמאתו, הא לא חסה התורה אלא על כלי חרס, שאין להם טהרה במקוה.</p> <footer class=source>רש״י, שם, ד״ה בטרם יבא הכהן וגו׳</footer></blockquote> <blockquote lang=he><p>ולא יבא קודם לכן ובין כך יהיה זמן תשובה ותפלה לבעלים וזמן תפלה לכהן, ועם זה נתן זמן הסגר.</p> <footer class=source>ספורנו, שם</footer></blockquote> <p>With this ספרנו we are starting to get a hint of a consistent philosophy behind these הלכות. But first, another aspect of the כהן's role:</p> <blockquote lang=he><p> וביום הראות בו בשר חי יטמא׃</p> <footer class=source>ויקרא יג:יד</footer></blockquote> <blockquote lang=he><p>מה תלמוד לומר, ללמד יש יום שאתה רואה בו ויש יום שאין אתה רואה בו, מכאן אמרו חתן נותנין לו כל שבעת ימי המשתה לו ולכסותו ולביתו, וכן ברגל נותנין לו כל ימי הרגל</p> <footer class=source>רש״י, שם ד״ה וביום</footer></blockquote> <p>There are times we don't even try to diagnose צרעת. The משך חכמה puts these together, noting the redundancy in פסוק ג:</p> <blockquote lang=he><p>...ויתכן ע״ד רז״ל שהכוונה שיראה את הנגע אם היא ראויה לטמאנה, הוא שיש בה סימן טומאה שער לבן. וראהו הכהן הוא שיראה הכהן על האיש אם ראוי לטומאתו, הוא אם חתן נותנין לו כל 7 ימי המשתה, וכן ברגל נותנין לו כל ימות הרגל שלא לערבב שמחתו ודרכיה דרכי נואם. ולכן רואהו איך הוא באיכותו אם הוא ראוי לפי הזמן לטומאתו...</p> <footer class=source>משך חכמה, ויקרא יג:ג, ד״ה וראה הכהן את הנגע וכו׳ וראהו הכהן</footer></blockquote> <p>If you think about it, when the כהן diagnoses צרעת, he is telling the person, "you have committed the grevious sin of לשון הרע". The skin lesion that exists is just a warning from ה׳ that a problem may exist; the final judgment is from the כהן. Isn't that an awful lot of power to give to a human being? And doesn't that make the כהן's declaration of טמא a form of לשון הרע itself?</p> <p>I think these הלכות are a lesson in how all of us are meant to give rebuke. The מצורע is commanded ובא אל אהרון הכהן. אהרון's defining characteristic is as a pursuer of peace:</p> <blockquote lang=he><p>הלל אומר, הוי כתלמידיו של אהרון--אוהב שלום ורודף שלום, אוהב את הברייות ומקרבן לתורה.</p> <footer class=source>משנה אבות א:יב</footer></blockquote> <p>So to be able to rebuke someone else, to declare them טמא, we need all four conditions to be fulfilled: we must be entirely רודף שלום, seeking only peace, not self-aggrandizement or sense of superiority. We must fulfill וראה הכהן את הנגע, be sure that what we have observed is in fact wrong. We have to fulfill וראהו הכהן, look at the person to see if the rebuke is appropriate. Are our standards too high? Will the person respond appropriately? And is it וביום הראות; is the time and situation appropriate?</p> <p>Declaring a person to have צרעת excludes him from כלל ישראל. It is not to undertaken lightly. The limits placed on it teach us how to deal with others throughout our everyday lives. </p>
