After the death of Aharon's sons, he is given a commandment not to get drunk when serving ה׳: <blockquote lang=he><p><b>ח</b> וידבר ה׳ אל אהרן לאמר׃ <b>ט</b> יין ושכר אל תשת אתה ובניך אתך בבאכם אל אהל מועד ולא תמתו; חקת עולם לדרתיכם׃ <b>י</b> ולהבדיל <em>בין הקדש ובין החל</em> ובין הטמא ובין הטהור׃ <b>יא</b> ולהורת את בני ישראל את כל החקים אשר דבר ה׳ אליהם ביד משה׃</p> <footer class=source>ויקרא פרק י</footer></blockquote> I want to look at that last pasuk, להורת את בני ישראל. That's not what I usually think of when I think of כהנים. They do the עבודה; they're not teachers per se. That role is what we call רבנות; it has nothing to do with the hereditary position of priesthood. But teaching does seem to have been the original intention for the role of the כהנים: <blockquote lang=he><p><b>ח</b> וּלְלֵוִי אָמַר תֻּמֶּיךָ וְאוּרֶיךָ לְאִישׁ חֲסִידֶךָ אֲשֶׁר נִסִּיתוֹ בְּמַסָּה תְּרִיבֵהוּ עַל מֵי מְרִיבָה׃ ...<b>י</b> יוֹרוּ מִשְׁפָּטֶיךָ לְיַעֲקֹב וְתוֹרָתְךָ לְיִשְׂרָאֵל; יָשִׂימוּ קְטוֹרָה בְּאַפֶּךָ וְכָלִיל עַל מִזְבְּחֶךָ׃</p> <footer class=source>דברים פרק לג</footer></blockquote> <hr/> Before getting to that, I want to look at an interesting hypothesis by Rav Kamenetsky. He looks at the wording of בין הקדש ובין החל, and notes that Biblical Hebrew is different from Mishnaic Hebrew: <blockquote lang=he><p>לשון תורה לעצמה לשון חכמים לעצמו.</p> <footer class=source>עבודה זרה נח,ב</footer></blockquote> <blockquote lang=he><p>הנה זהו סגנון המקרא, דהיינו כל פעם שרוצה לחלק בין שני עניינים מבדילם הכתוב על ידי שני פעמים ”בין“, וכגון (בראשית א:ד) בין האור ובין החשך, (שמות כו:לג) בין הקדש ובין קדש הקדשים, (ויקרא יא:מז) ובין החיה הנאכלת ובין החיה אשר לא תאכל. אבל לשון חז״ל אינו כן, אלא תמיד הם נבדלים ע״י ”בין“ אחד, כמו המבדיל בין קדש לחול, בין אור לחשך, בין ישראל לעמים, והיינו שהפחות נבדל מהראשון ע״י האות למ״ד.</p> <footer class=source>אמת ליעקב, ויקרא י:י</footer></blockquote> And then he notes that there is an apparent מחלוקת between the מחבר and the רמא about the wording of הבדלה. <blockquote lang=he><p>אסור לעשות שום מלאכה קודם שיבדיל ואם הבדיל בתפלה מותר אע״פ שעדיין לא הבדיל על הכוס ואם צריך לעשות מלאכה קודם שהבדיל בתפלה אומר <em>המבדיל בין הקודש ובין החול</em> בלא ברכה ועושה מלאכה.</p> <p> הגה: וכן נשים שאינם מבדילין בתפלה יש ללמדם שיאמרו <em>המבדיל בין קודש לחול</em> קודם שיעשו מלאכה.</p> <footer class=source>שולחן ערוך, אורך חיים רצט:י</footer></blockquote> And to explain that, he looks at another מחלוקת , in the wording of the ברכה for הפרשת חלה: <blockquote lang=he><p><b>יז</b> וידבר ה׳ אל משה לאמר׃ <b>יח</b> דבר אל בני ישראל ואמרת אלהם; בבאכם אל הארץ אשר אני מביא אתכם שמה׃ <b>יט</b> והיה באכלכם מלחם הארץ תרימו תרומה לה׳׃ <b>כ</b> ראשית ערסתכם חלה תרימו תרומה; כתרומת גרן כן תרימו אתה׃ <b>כא</b> מראשית ערסתיכם תתנו לה׳ תרומה לדרתיכם׃</p> <footer class=source>במדבר פרק טו</footer></blockquote> <blockquote lang=he><p>בשעה שיפריש חלה יברך ”אשר קדשנו במצותיו וצונו להפריש <em>תרומה</em>“.</p> <p>טור: או ”להפריש <em>חלה</em>“. </p> <footer class=source>שולחן ערוך, יורה דעה שכח:א</footer></blockquote> <blockquote lang=he><p>ועוד י״ל באופן אחר, דלא פליגי בעיקר תקנת לשון הברכות, אלא דתרווייהו הכריעו דתלי בזה: דאם המצוה דאורייתא תקנו ברכתה בלשון המקרא, ואם קיום המצוה אינה אלא מדרבנן גם נוסחת הברכה בלשון חכמים תקנוה. ולפיכך המחבר שהיה בארץ ישראל--דמצות חלה שלה מן התורה--לפיכך ברכתה ג״כ בלשון התורה ”להפריש תרומה“, אבל הרמ״א שהיה בחו״ל כתב ”או להפריש חלה“ והיינו לשון חכמים.</p> <p>...וכיון שכן י״ל דהמחבר והרמ"א לענין הבדלה אזלי לטעמייהו, דהנה באו״ח (ריש סי׳ רצ״ו] כתב המג״א וז״ל: הרמב"ם פכ״ט כתב דהבדלה היא דאורייתא וי״א שהיא מדרבנן ...הרי שחש [רמ״א] לדעת יש מי שחולק, ולפיכך העתיק הוא המבדיל בין קודש לחול, אבל המחבר דס״ל דהבדלה דאורייתא שפיר ס״ל לומר בין הקודש ובין החול וכלישנא דהפסוק שלפנינו, ודו״ק.</p> <footer class=source>אמת ליעקב, ויקרא י:י</footer></blockquote> There is a difference between מצוות דאורייתא and מצוות דרבנן. The Torah says (דברים יג:א) לֹא תֹסֵף עָלָיו. We can't create new מצוות. But the rabbis have the authority to create תקנות and גזרות, which in effect *are* new מצוות, but we need to be aware that they are not דאורייתא. We do them because of the authority of חז״ל (דברים יז:יא; על המשפט אשר יאמרו לך תעשה), not because they were commanded by הקב״ה. Rav Kamenetsky is suggesting that one way we keep the distinction is by using different languages for the ברכות; לשון תורה for מצוות דאורייתא and לשון חכמים for מצוות דרבנן. Of course, that implies that we are educated enough to be able to tell the difference! I don't know whether he systematically went through the ברכות to see if it held up, but it hilights this important distinction. <hr/> Why is that relevant to original question? In the Tanach shiur, I <a href="/Happily+Ever+After/">pointed out</a> that there is a summary of David's administration, and it included כהנים: <blockquote lang=he><p><b>יד</b> וימלך דויד על כל ישראל; ויהי עשה משפט וצדקה לכל עמו׃ <b>טו</b> ויואב בן צרויה על הצבא; ויהושפט בן אחילוד מזכיר׃ <b>טז</b> וצדוק בן אחיטוב ואבימלך בן אביתר כהנים; ושושא סופר׃ <b>יז</b> ובניהו בן יהוידע על הכרתי והפלתי; ובני דויד הראשנים ליד המלך׃</p> <footer class=source>דברי הימים א פרק יח</footer></blockquote> Why are כהנים part of the government? The Torah says that for judgment, we have to look both to the שופט and to the כהן: <blockquote lang=he><p><b>ח</b> כי יפלא ממך דבר למשפט בין דם לדם בין דין לדין ובין נגע לנגע דברי ריבת בשעריך; וקמת ועלית אל המקום אשר יבחר ה׳ אלקיך בו׃ <b>ט</b> ו<em>באת אל הכהנים הלוים ואל השפט </em> אשר יהיה בימים ההם; ודרשת והגידו לך את דבר המשפט׃ <b>י</b> ועשית על פי הדבר אשר יגידו לך מן המקום ההוא אשר יבחר ה׳; ושמרת לעשות ככל אשר יורוך׃ <b>יא</b> על פי התורה אשר יורוך ועל המשפט אשר יאמרו לך תעשה; לא תסור מן הדבר אשר יגידו לך ימין ושמאל׃</p> <footer class=source>דברים פרק יז</footer></blockquote> The kohanim are the keepers of the original ספר תורה: <blockquote lang=he><p>וַיִּכְתֹּב מֹשֶׁה אֶת הַתּוֹרָה הַזֹּאת וַיִּתְּנָהּ אֶל הַכֹּהֲנִים בְּנֵי לֵוִי הַנֹּשְׂאִים אֶת אֲרוֹן בְּרִית ה׳; וְאֶל כָּל זִקְנֵי יִשְׂרָאֵל׃</p> <footer class=source>דברים לא:ט</footer></blockquote> And so Rav Naftali Bar-Ilan (grandson of Rav Meir Bar Ilan, great grandson of the Netziv) that this was the role of the כהנים: to preserve the text, to be the carriers of tradition, not just in ritual, but in תלמוד תורה as well: <blockquote lang=he><p>ניתן לפרש את הפסוק בדרך נוספת. אם יפלא מבית דין שבעיר דבר הקשור לנוסח המקרא--”ובאת אל הכהנים הלוים“, שהם מופקדים על שמירת תורה שבכתב והוראתה [ראה דברים לא:ט] והם יבררו את הנוסח המדויק על פי הספר המונח בעזרה. וראה מלכים ב כב:ח, וַיֹּאמֶר חִלְקִיָּהוּ הַכֹּהֵן הַגָּדוֹל עַל שָׁפָן הַסֹּפֵר סֵפֶר הַתּוֹרָה מָצָאתִי בְּבֵית ה׳... וראה בבלי חגיגה יא,א: ”אי מסתפקא לך מילתא בנגעים עיין בקראי“, ומובן מפני מה גזרה התורה שדוקא כהנים רואים נגעים...ואם יפלא מדייני העיר דבר הקשור לתורה שבע״פ, עליהם לפנות ”ואל השפט אשר יהיה בימים ההם“, היינו אל בית הדין הגדול.</p> <footer class=source><a href="http://www.eretzhemdah.org/data/Uploadedfiles/ftpuserfiles/books/government_and_country/1.pdf#page=156">נפתלי צבי יהודה בר-אילן, <cite>משטר ומדינה בישראל על פי התורה, כרך ראשון</cite></a>,עמ׳ 118, הערה 23</footer></blockquote> There is a dialectic inherent in our understanding of Torah, between innovation and conservatism. They inhabit a world that is timeless, ahistorical, in which nothing significant changes. The daily, weekly and yearly sacrifices were always the same. Every element of the service of the Tabernacle was bound by its own detailed rules, and nothing of significance was left to the discretion of the Priest.</p> <p><em>The Priest was the guardian of order.</em></p> <p>...<em>The priestly vocation was to remind the people that there are limits.</em> There is an order to the universe and we must respect it. Spontaneity has no place in the life of the Priest or the service of the Sanctuary. That is what Nadav and Avihu failed to honour.
