Thoughts on Tanach and the Davening

This is largely based on Rabbi Michael Taubes’s chaper on צו, from Mitokh Ha-Ohel.

The first half of our parasha deals with the procedures for the various sacrifices. It ends with a summary:

לז זאת התורה לעלה למנחה ולחטאת ולאשם; ולמלואים ולזבח השלמים׃ לח אשר צוה ה׳ את משה בהר סיני; ביום צותו את בני ישראל להקריב את קרבניהם לה׳ במדבר סיני׃

ויקרא פרק ז

The Gemara picks up on the term תורה to make these parshiot relevant to our time, when we cannot bring sacrifices:

אמר ריש לקיש: מאי דכתיב (ויקרא ז) ”זאת התורה לעולה למנחה ולחטאת ולאשם“? כל העוסק בתורה כאילו הקריב עולה מנחה חטאת ואשם.

However, רבי יצחק in the same Gemara makes this point from other psukim in our parasha:

דבר אל אהרן ואל בניו לאמר זאת תורת החטאת; במקום אשר תשחט העלה תשחט החטאת לפני ה׳ קדש קדשים הוא׃

ויקרא ו:יח

וזאת תורת האשם; קדש קדשים הוא׃

ויקרא ז:א

אמר רבי יצחק: מאי דכתיב (ויקרא ו) ”זאת תורת החטאת“ ”וזאת תורת האשם“? כל העוסק בתורת חטאת כאילו הקריב חטאת, וכל העוסק בתורת אשם כאילו הקריב אשם.

What is רבי יצחק coming to add? Is his opinion different from ריש לקיש?

Rashi (and most others) say it is different. ריש לקיש claims that any learning, כל העוסק בתורה, is equivalent to offering sacrifices. רבי יצחק requires learning the laws of the sacrifices themselves, כל העוסק בתורת חטאת:

בתורת חטאת: כגון סדר קדשים דמיירי בהלכות עבודה.

But then, why mention specifically the חטאת and אשם? The phrase זאת תורת appears multiple times earlier in the parasha, once for each sacrifice:

צו את אהרן ואת בניו לאמר זאת תורת העלה; הוא העלה על מוקדה על המזבח כל הלילה עד הבקר ואש המזבח תוקד בו׃

ויקרא ו:א

וזאת תורת המנחה; הקרב אתה בני אהרן לפני ה׳ אל פני המזבח׃

So the Maharsha says that רבי יצחק is specifically talking about sin offerings:

לזה נקט ר״י במלתיה חטאת ואשם ולא נקט עולה ומנחה כדנקט לעיל, משום דעולה ומנחה באו בנדבה ולא אצטריך ליה לפרש דודאי הוה ממש כאילו הקריבו מנחה בנדבה. אבל בחטאת ואשם שלא באו בנדבה אימא דלא תיהני ליה עסקו בהן; מש״ה קאמר דאפילו כן בעסקו בהן נוטל שכר כאילו חטא ודאי והקריב חטאת ואשם.

What does כאילו חטא ודאי והקריב חטאת ואשם? You might want to read it as “if one needs to bring a sin offering, then studying the laws is considered as though they brought it”. But that’s not what the Maharsha says. Studying the laws of sin offerings is like sinning, then bringing the offering. Is that a good thing?


Rabbi Taubes says that, yes, it could be a good thing. He brings the famous Gemaras about בעלי תשובה:

דא״ר אבהו: מקום שבעלי תשובה עומדין צדיקים גמורים אינם עומדין, שנאמר (ישעיהו נז) ”שלום שלום לרחוק ולקרוב“ לרחוק ברישא והדר לקרוב.

ברכות לד,ב

א״ר יונתן: גדולה תשובה (שמקרבת) [שמביאה] את הגאולה שנאמר (ישעיהו נט) ”ובא לציון גואל ולשבי פשע ביעקב“; מה טעם ובא לציון גואל? משום דשבי פשע ביעקב. אמר ריש לקיש: גדולה תשובה שזדונות נעשות לו כשגגות שנאמר (הושע יד) ”שובה ישראל עד ה׳ אלקיך כי כשלת בעונך“ הא עון מזיד הוא, וקא קרי ליה מכשול. איני? והאמר ריש לקיש: גדולה תשובה שזדונות נעשות לו כזכיות שנאמר (יחזקאל לג) ”ובשוב רשע מרשעתו ועשה משפט וצדקה עליהם (חיה) [הוא] יחיה“! לא קשיא—כאן מאהבה כאן מיראה.

Why is being a בעל תשובה so good? Here’s how Rav Dessler puts it:

בעל התשובה מצטער ורואה עוצם שפלותו במה שבחר ברע ובזדון חטא, וזה עצמו יהיה שורש לעליתו בתשובתו כי יראה את עוצם גדולתו יתברך שבחסדו לא דחפו אלא עזרו בתשובתו וכו׳.

ואמרו ז״ל, ”זדונות נעשות לו כזכיות“. ויש בזה לבאר, כי כשם שהזכיות…מצמיחות עליה רבה לעוה״ב, כך הרגשת השפלות הזדונות שמרד בהם בפועל…מצטרפת היא עם התשובה לעליה גדולה ונפלא לעוה״ב. ואמרו עוד, ”מקום שבעלי תשובה עומדין צדיקים גמורים אינם עומדין“—מתבאר בזה, כי יען שבעל־התשובה מבחין יותר בשפלתו…הרי על ידי זה ישחג יותר את עוצם ענותנותו וחסדו יתברך כנ״ל.

Then Rav Dessler adds a parenthetical note:

פשוט הוא, כי יש בחינות אחרות אשר הוית הצדיק מעקרו מעולה היא הרבה מבע״ת.

He needs to say this because, like most things that are “obvious”, this isn’t obvious at all. This is really a very dangerous idea. If תשובה is so wonderful, shouldn’t we all try to experience it? Doing a sin seems like a small price to pay to be able to stand where צדיקים גמורים אינם עומדין. This was an essential point of the Shabtai Tzvi’s heresy:

[T]he nihilism of the Sabbatian and Frankist movements, with its doctrine so profoundly shocking to the Jewish conception of things that the violation of the Torah could become its true fulfillment (bittulah shel torah zehu kiyyumah), was a dialectical outgrowth of the belief in the Messiahship of Sabbatai Zevi, and that this nihilism, in turn, helped pave the way for the Haskalah and the reform movement of the nineteenth century, once its original religious impulse was exhausted.

As long as the last divine sparks (nitzotzot) of holiness and good which fell at the time of Adam’s primordial sin into the impure realm of the kelipot (the hylic forces of evil…) have not been gathered back again to their source—so the explanation ran—the process of redemption is incomplete. It is therefore left to the Redeemer, the holiest of men, to accomplish what not even the most righteous souls in the past have been able to do: to descend through the gates of impurity into the realm of the kelipot and to rescue the divine sparks still imprisoned there.

[From an essay by a Sabbatean:] “But perhaps one can interpret the meaning of the text as follows: since such a person intends his deeds to redound to the benefit of all Israel … if after sinning and passing through the kelipah he reconsiders and repents completely, he undoubtedly succeeds in raising up many sparks from the kelipah.”

Among the leaders of the Donmeh the antinomian blessing composed by Sabbatai Zevi, “Blessed art Thou O Lord our God, King of the universe, who permittest the forbidden [mattir isurim],” became a byword.

Gershom Scholem, Redemption Through Sin

תשובה is a uniquely Jewish idea, and the Sabbatean heresy is a uniquely Jewish heresy. Its reasonableness is what makes it so dangerous.

Rabbi Taubes proposes that this is what the Maharsha means:

[I]t is apparent that one who has sinned and then repents is, at least in some sense, on an unparalleled exalted level; one who studies the Torah of the chatat offering, by virtue of being considered as having sinned and brought the requisite sacrifice as part of his repentance, is perhaps regarded as having attained that level as well.

So רבי יצחק is saying, in this interpretation, that there is no reason to be jealous of the בעל תשובה. To be able to stand שבעלי תשובה עומדין, you can’t intentionally do an עבירה just to do תשובה, but you can be part of כל העוסק בתורת חטאת כאילו הקריב חטאת, and that is כאילו חטא ודאי והקריב חטאת.


And ריש לקיש? Rabbi Taubes suggests that he is not disagreeing with this idea, but would extend it further. Any Torah learning can bring one to the same elevated state as the בעל תשובה; as he says, כל העוסק בתורה כאילו הקריב עולה מנחה חטאת ואשם. The cure for the יצר הרע (at least the sophisticated יצר הרע that leads to מתיר איסורים) is the בית המדרש:

אמר רבי שמעון בן לקיש: יצרו של אדם מתגבר עליו בכל יום ומבקש להמיתו שנאמר (תהילים לז) ”צופה רשע לצדיק ומבקש להמיתו“. ואלמלא הקב״ה שעוזר לו אינו יכול לו שנאמר (תהילים לז) ”ה׳ לא יעזבנו בידו ולא ירשיענו בהשפטו“. תנא דבי רבי ישמעאל: אם פגע בך מנוול, זה משכהו לבית המדרש. אם אבן הוא נימוח; אם ברזל הוא מתפוצץ.

And Rabbi Taubes adds that ריש לקיש is the archetype of the בעל תשובה who is cured by Torah:

יומא חד הוה קא סחי ר׳ יוחנן בירדנא. חזייה ריש לקיש ושוור לירדנא אבתריה. אמר ליה חילך לאורייתא! אמר ליה שופרך לנשי! א״ל אי הדרת בך, יהיבנא לך אחותי דשפירא מינאי. קביל עליה. בעי למיהדר לאתויי מאניה ולא מצי. הדר אקרייה ואתנייה ושוייה גברא רבא.
